The parent(s) decide. Also when you beat your own child, which is why it's rarely prosecuted. However, if the child needs medical treatment it's on the next level of the scale, it's no longer "einfache Körperverltzung", which I think makes it to be mandatorily prosecuted. I also seem to remember that the medical personnel must report these incidents, overriding the "ärztliche Schweigepflicht", their duty to keep things confidential.

Just catching up on this thread...

Back in 1994, I know for a fact that it was illegal to smack a child in Austria. I got married in Salzburg and had to make my 4yr old bridesmaid's mum aware of this law as she was prone to giving her a slap across the back of her legs. At the time, the parent could be arrested on the spot and the maximum jail (yes! jail!) sentence was 5yrs.

I'd be very surprised if Switzerland didn't have a similar law.

Why? Switzerland isn't Austria, and laws vary between Cantons, never mind countries.

Anyway, as noted at the start of this thread, it is legal within certain restrictions.

I'm more partial to wanting to beat the f@@k out of the parents in this type of case. Most children will act within the boundaries set by the parents.Parents allowing their kids to completely run amok and disturb everyone else does my head in! Not the kids fault, it's the parent!
