vaccination dispute

I'm the father of a 7 y.o. and the mother (we're single parents) disagrees to any kind of vaccination. In fact, my daughter has no vaccinations at all so far not even against Tetanus, Poliomyelitis or Measles. My ex flat disagrees and is against any vaccination. She also chose a Swiss Pediatrician that is aligned with her opinions.

Does the mother has the full saying on this matter? Do I as the father have any right to force vaccination? what would you do in my shoes? take the legal path?

What do you mean by taking the legal path?
Vaccinations are not mandatory in Switzerland, there are just legally non-binding recommendations, so the mother's view is completely fine from a legal point of view.

Not even Tetanus Plain bonkers.

Do you have shared custody? Does your child visit you? Extreme decision would be to get her the shots during a visit. It could be that this is considered as a routine intervention were the other's parent consent is not needed. But check first with a lawyer as the backlash can be severe.

There is a case in Basel Land where a father went to the civil court. This particular court said that vaccination are not vital, child's wellbeing is not in danger when there is no vaccination. So the father has no say, as non-vaccination is the default state.

There is no case law in Switzerland. Do not get put off by this decision. Each case is considered unique, with the right argumentation, expert support you could win your case in the same court/same judge, even Federal Court.

Can't you just have her vaccinated when she is with you?

It will not do the relationship with the mother any good though.

Hmmm, that Mum should be made to visit a hospital and whilst at it, also a a residental home for handicapped children to see what might happen if she lets her daughter remain unprotected against many illnesses. Or better, the mum should endure one of those illneses you can vaccinate against nowadays, it is no laughing matter!!!!!

I am a daughter of a man who had Polio as a kid (and saw subsequently first-hand all the hurdles he had to over come)....and then I went and trained in a nursing profession.

During my working years in nursing (1984-1996) I came across; handicapped kids that caught measles and became blind and/or deaf, 2 elderly farmer's wives not having had tetanus shots, hurt themselves gardening and both developped catalepsy, one of them died.
Several elderly people that suffered from tuberculosis and pertussis.......without question my offspring all got inoculated!

One thing I also think super important in young girls and boys ,is the HPV (human papilloma virus) vaccination, which will help prevent cancer of the reproduction organs

Unfortunately, there seems not much that you can do, but hope that your girl might one day decide herself to get vaccinated....or maybe shock the mother into action by showing her what might happen.......

If needed I would find another doctor who is willing to give the vaccinations, and if my wife would hate me for that, so be it. I'd be willing to have a divorce over such. The trouble of a divorce will be so much less than the pain me and the kid would have if he manages to catches one of these disease that easily could have been prevented.

Sorry, semi serious . But HPV affects the male population and their reproductive organs as well. Luckily, the vaccination is now also approved and available cost free for boys.

It would be great having my ex meet with someone like you who has unfortunately experienced those horrible diseases from very close. My ex has the very narrow minded attitude "it won't happen to us because we live in Switzerland, it is very safe and none of those diseases exist here ..."

1. There is no legal need to change a situation.
2. Mother wants to keep situation as is.
3. Father wants to chance the situation.

How can a judge force any action to be undertaken if there is no legal ground for it?

Like it or not, a court is not the place to be for this.

We had a doctor in Switzerland try and prescribe my daughter homeopathic remedies.

Let's not forget it was a medical doctor that started the whole vaccines cause autism mess.

Well, at the moment there is even someone in the Bundesrat, who ensured in their previous position that anti-vax views are being propagated.

I actually called and had a chat with the anti-vax Swiss pediatrician primary doctor of my daughter. I called because I get specially uneasy while traveling to some place where there have been reports of recent outbreaks of at least one of those diseases.

I was going for holidays with my daughter to Genoa Italy where there have been Measles outbreaks recently due to lack of vaccination https://www.thelocal.it/20181115/man...sles-outbreaks. We were going to visit the Genoa Aquarium which has not only locals but also people from all over the world visiting.

The answer from the Swiss pediatrician was "which exact Measles strain vaccination are you thinking about? because there are multiple Measles strains and doesn't make sense vaccinating against all of them. The only thing that you should worry about is not having a car accident rather than being exposed to Measles. If you convince the mother then I will be happy to vaccinate your daughter".

Needless to say, I broke out in a sweat every time a kid coughed at the Aquarium.
