Kinderzulage (child allowance) complication. Need to repay money back.

Good day to all.

Probably the damage is done, but decided to post it here for some advice.
Since my arrival here I've set up einzelfirma.
From day one I pay provisional 432 chf pension contribution.
Paid provisional tax, etc.
After 3 and a half years the tax office has made calculation on final / official figures, and wrote me that I need to return all Kinderzulage (child allowance) for 2016 and 2017.
Reason, my first year and a half of the start of the business where bad / they are not happy with the numbers and by law I'm not allowed to claim Kinderzulage (child allowance).

I'm shocked for many things.
Why they waited for so long.
What about my life here?
Kids go to school from day one.
From day one I pay rent for the apartment
Rent in the workshop
Health Insurance, Car leasing, and all the rest of it.

Shall I just accept it (start repaying the money) and move on?

Are you a single parent?
If not, is the other partner of the children working in the same canton?
Are you employed by your GmbH/AG or self employed (Einzelfirma)?

No. My wife doesn't work all that time. Youngest child just started school.
I'm self employed (Einzelfirma)

Did you come above the minimum to be able to be entitled to the allowance or did you have low profit and such deductions that taxable income was to low?

o.k. this affects order of competence of cantons.
Wife never worked in CH. She is full time mother of 3 children.

That must be an odd case then.

Looks like you did not earn enough (CHF 7‘110) self employed income subject to AHV (which would make you "non employed" Art. 19 Abs 2 FamZG https://www.admin.ch/opc/de/classifi...index.html#a19 ) but had somehow other taxable income which would put you over the non-employed low-income threshold (CHF 42‘660) Art. 19 Abs 3 FamZG and thus not eligible for Kinderzulage

Not really my field, but can it be that he never was registered as Nichterwerbstätige at the AHV, I'd expect them to have a bunch of money of their own (how else can one survive so long with such low income) and AHV would also calculate monthly payment based on capital which in my opinion should put his monthly payment above 432,- a month.

But hard to say without their exact explanation and all of his taxpapers. I think OP should start with a visit to the office to get clear for himself why exactly they want their money back, and maybe they made a mistake.

Quite. Nothing wrong with having little or no income whilst living off savings. Plenty of Swiss don't work and just live off a full bank account.
I had several years where my outgoings (health costs and rent alone) on my tax returns exceeded my very little or no income.
