US National married to UK national in USA getting a divorce in CH

Hello All,

Bit of a downer question, but would be grateful for some info if you have any.

My wife and I have been married for a while and moved to CH about 2 years ago. The marriage has been strained and there are moments when she states a divorce would be preferable. Great news for me seeing as I was supporting her career choices and moved to further her career. Score one for Feminism.

My question is does anyone know the legal scope of a Swiss initiated divorce on a US marriage of UK and US national? I know I will be forced to leave the country as I have a B permit. But more concerned with assets and alimony issues.

Sorry things didn't work out...but just because they didn't, it doesn't mean a husband shouldn't be supportive of his wife's career.

Having just been dragged to another continent, then faced with the possibility of expulsion and having to build a life again from scratch, I suspect the OP could probably do without a lecture right now.

Sorry to hear about this. Never easy. I would talk to a lawyer and get clarity on the process. I guess you will need to think about how the law applies across the 03 geographies and legal advise will be helpful. All the best.

You might find some help from the organisation called www.binational.ch. Although a part of their work is negotiating between couples from two different cultural backgrounds, they also have information on legal aspects to consider with regard to spanning several countries.

If the court has jurisdiction, and in particular if you both reside in Switzerland (and notably if you are “domiciled” there in the Swiss sense) and both appear in the proceeding, the resulting divorce will be recognised everywhere that divorce is not prohibited as against public policy.

My grandfather, living in Zurich, divorced my grandmother who had lived in New York for decades already. She signed some papers, that was all. The divorce increased his Swiss pension.

Thank you all for the sympathies. Not the ideal situation. I figured seeking a lawyers advice is probably the best route, but wanted to see if anyone else had gone thru something similar. The sites you have linked do have some good resources though. Going to try counselling first and use the nasty "D" as a last resort.
