Bitten by Bedbugs - Lawsuit Possible?

Hi!


My wife and I moved into an apartment in early August. Shortly afterwards, we noticed what looked like mosquito bites on our legs and arms. So we made sure to close the windows at night, and the next day we had even more bites.


I have over 100 on my body now. We are pretty sure we have been bitten all over by bed bugs. My wife and I are in considerable pain.



My question is - do we have a lawsuit? The apartment is a furnished apartment from an international supplier of furnished apartments. If this were the US, I know we could sue but I don't know much about the rules in Switzerland.


So help! Any advice would be most welcome!

Just ask them yo remove bed, get appropriate rent discount and get a new bed from ikea...

Under Swiss law you can only sue natural or legal persons, since bedbugs are neither, that would be a no.

I would argue that one might want to have the cost of replacing clothing and other stuff that can't be frozen and subsequently heated to 65°C reimbursed.

I have no idea how easy it would be to actually get that from the short-term rental company though.

If you plan on staying longer, consider taking legal insurance.

I recommend you retain 1-3 legal experts in CH and sue the crap out of them. you have an airtight case!

A pest control company will be happy for the business. Getting the rental agency to pay is the issue. Having the bites looked at by a doctor is a good idea - around here water fleas in the lakes in summer are also a common cause of irritating bites

The concept of punitive damages doesn’t exist here. Only actual and proven damages can be claimed. Mental stress, etc are not included. And of course your lawyers will expect their fees.

Document your actual and proven costs and present them them for reimbursement. They may surprise you.

First you'd have to make sure, what exactly it was that bit you. If there are so many of them bugs around that you get hundreds of bites, it must be easy to catch a few of the perpetrators.

Then talk calmly to the landlord, if they'd be willing to pay for someone to investigate/clean up. It might be in the landlord's best interest to know about pests in his building; I am sure, they don't want to lose business.

Take it from there and give them a chance to make it right. No need to sue, no-one dies from a few bug-bites, just go and buy an ointment and a bit of bug-dope.

It seems unlikely that OP brought the critters along, they would have had the problem at their old apartment already. If it turns out that they have been inplace when OP moved in, it means the apartment was not in a usable state. This would make it the owner/agency's responsibility, including paying for side costs like a new mattress if necessary, "cleaning" the clothes, temporary hotel or other accomodation, meals, etc. Certainly the critters have left traces if they have been there for some time, that should tell if it's OP's problem or not. Alternatively, maybe an earlier removal was unsuccessful.

OP, act immediately and raise the issue with the owner/agency, the fastest way is best. Make sure you can prove later on that you reacted (their reply to your email should do, when in doubt send a letter by registered mail and do keep the receipt and letter - personally, I always photocopy the recipt because the original tends to fade and become unreadable).
