With any services here in Switzerland, and elsewhere, after you've clarified costs you should talk about expectations, even to the point of creating a service level agreement.


Your surgery might have been considered as for purely functional reasons then it seems they often don't give a monkey's about the aesthetics.



I understand it can be very disappointing when you're left with an unexpected disfigurement. I don't know all the details but I find the all too common unkind comments here to be unnecessary.

I find it surprised to see some of the comments here that it is not comment to make a complaint in Switzerland for cases like this.
What is the right of a patient?
If anyone has ever experience an annoying scar on his/her face, I believe he/she will understand how bad that experience is.
And of course, if the doctor makes it very clear before the surgery that there is a risk for scar, then there is nothing to complain.
I feel that in this aspect, Switzerland is quite left behind and pretty disappointing.

You need to decide if you are suing for damages, demanding the problem is resolved, or complaining about professional misconduct by the surgeon - they are all different things.

Suing for damages - you need to speak to a lawyer, they will advise you, as others have said the realistic advice is probably to forget it.

Complaining about the surgeon - get in touch with FMH.

Getting the problem resolved - speak to the surgeon and the clinic, and also your health insurance. Personally I would expect the cosmetic result of surgery to be quite relevant on the face, more so than on other aresa.

I would say the last one is the most sensible, and probably also a pre-requisite anyway for further steps on the others.

The concept of punitive damages doesn’t exist. It is not the rôle of the courts here to punish one party, but to fix the damages.

After over 6 months you come back to complain just as you did when you started this thread. If you review the thread you can see you've been given some helpful advice. Did you follow it?

To summarise:

Of course you can complain and seek rectification. You an even sue. There's absolutely nothing to stop you. You have every right. But you won't get punitive damagers.

What is the issue you are suing for exactly? What do you think went wrong? What are you looking for? Have you followed the suggestions given?
