Surrogacy in Ukraine for Switzerland-based parents to be

Hi everyone,

I was wondering if any of you had some experience / knowledge of going through gestational surrogacy in Ukraine and then bringing the baby to Switzerland?

I know it is not an easy process but it is possible.

Mostly looking for success stories, agencies and lawyers worth recommending etc

Take a look at this thread, which is a bit older but has some links.

Given how slowly the Swiss change rules, I'd doubt things have changed dramatically since. Surrogacy is still illegal here, so I'm not sure how doing it in another country easily gets around the rule. A Ukranian birth certificate could certainly raise eyebrows more than say, a Greek or Belgian one.

While some things have changed since the thread posted by 3Wishes, surrogacy is still illegal in Switzerland.

The father living in Switzerland will have to adopt the child (if he is the biological father). The mother will have to adopt the child as well. So that means as a couple they have to meet all the rules for adoption. And the rules on adoption in Switzerland are very strict (there is also an age limit).

What has changed since the older thread is that same sex couples are now allowed to adopt. And they can marry.
But I don't think that is the case of the OP of this thread.

Maybe the OP knows this already.
I would not do it OP even if its hard. As stated in the other tread try to forster or similar.

Curious if someone knows how does it work in practice, do they launch investigations or something?

If the surrogacy is done in the country where it is legal to list the Swiss couple as parents, the couple enters Switzerland with a birth certificate where they are both listed as parents - what questions might there be from Swiss authorities at that point?

If you read some of the articles linked in the previous thread, and do some online searches about surrogacy, certain countries are a bit more...suspect...than others when it comes to possible human trafficking or outright baby selling.

The average Swiss resident doesn't rock up to the gemeinde with a new baby and a shiny birth certificate from Ukraine. Unless they are Ukranian, which of course wouldn't raise too much of a fuss.

I gave a look at the other thread and I understand that some situations are suspicious from the Swiss government perspective, but even then I am curious what happens in practice. Since the certificate is authentic, what would the Gemeinde be able to do in your scenario where there is a Swiss couple rock up with an Ukrainian birth certificate? "Do you happen to have specific proof that this child actually came up from that woman's uterus?"

Sine this is Switzerland, I will not be (well, not too much) surprised if they launch investigations or at the very least make you sign a sworn statement of being the biological parents. Just curious if something is done in practice or not

To come to Gemeinde they need to bring the baby to Switzerland first. And to do this they probably need to apply to the Swiss Embassy in Ukraine to get the citizenship and the travel document for the baby, no?

I would assume that unless the mother was in Ukraine for the last 9 months, there would be some medical records showing a pregnancy in Switzerland...

I assume registering a baby at the Swiss embassy in Ukraine, as born in Ukraine during a "holiday", without any record in Switzerland of a pregnancy may raise some flags...

It is very, and I say very difficult to meet the criteria for adoption here, imagine you show up with a baby you "gave birth to during a holiday in Ukraine".
Yeah, that won't raise suspicions at all. Frankly, I think it is excellent that you cannot fool (or bribe) authorities like that.

In Switzerland there is a special term for „surrogacy in Ukraine“ - human trafficking.

This is true and its seems also much harder to to say the UK or the US. And many people seem not be aware of this. See the many posts (also in the thread linked to in this thread) suggesting adoption instead.
