Divorce advice needed

I am a UK citizen and my husband is non EU but has a B permit through me. We have been married for a year but I can easily say it has been the unhappiest year of my life. I am still young and basically want my life back. There are many things which have happened over the year and I just want to know what is the easiest and quickest way out of this mess and to get a divorce. We have no children together, my husband has not worked and is completely financially dependent on me. Does anyone know what he would be entitled to and what would be the cheapest and easiest way to go about trying to solve this? Has anyone done an online divorce and how did it work? We got married in Brazil but we are both now resident in Switzerland. I would prefer to go about precedings here as I will understand what is happening, as I am not fluent in Portugeuse. Is this possible?

I'm no expert but I'm guessing a lawyer would be a first point of call?!

I am working two jobs, so 13 hour working days. I may have only been married for a year but I have good reasons to want out. Sticking is not always the best solution. Believe me.

Not necessarily so! It depends on your marriage contract, how it is interpreted here and how good his lawyer is, there is aways the chance he might get:

- Half your assets....
- Pension Fund....
- Financial support in the future.....

Bottom line get solid legal advice before you do anything...

Now I am not a lawyer, but I have been a party to some proceedings here in CH.

I'm pretty sure you don't have to go to Brasil to get divorced just because you got married there...otherwise Las Vegas would be pretty full.

One thing I can say regarding Switzerland is that during a divorce here what they do is take the amounts which were accumulated in the pension funds of both parties, and then split it evenly. So in your case if you were working 13 hour days, and he was chilling on the couch - you will likely get shafted. That's the bad news.

But the good news is, since there are no kids you will not have to pay for this guy's life after the divorce, even if he is dependent on you now.

After being present in Switzerland for only a year, he will probably be getting shipped to Brazil once the divorce is finalized, his B permit expires, and he still doesn't have a job.

However, I agree with the previous posts and I think you should consult a lawyer.

You don't need a lawyer to get a divorce in Switzerland. You can also use a financial advisor to settle your accounts and then be present when you have your case presented to the divorce judge. This only works when both parties are clear of what their rights are and are happy to sort out their finances between themselves. If there is any doubt or arguments brewing, then you need to cover yourself, bite the bullet and get the legal eagles involved.

Would you have more rights if you divorced him in the UK? If he has been living off you for a year he may not want to be parted from his cupboard love, could claim that he is suffering form depression, which makes find a job difficult etc.?

We are both resident in Switzerland though, I`m not sure if I could get divorced in the UK and whether I would work out better. I have said nothing to him but it is pretty obvious things aren`t working out! I just wanted to get all the right information before I approach him.

do you think he would be against the divorce? if so- get all your advice and plans figured out beforehand, just to protect yourself.
and remember, although it sounds like you've made your mind up and i'm positive you have good reason for wanting the divorce, but i speak from experience that the first year- especially when living in a new country and all the changes that come with this, is definitely not an easy one.

The only reason he wants to stay married is to keep his permit and to have some one pay for him. So yes I think he will try to contest it. Lots of things have happened, don`t want to try anymore! Thanks so much for everyone`s replies so helpful. Will be heading to the legal eagles!!

Good Luck! It would be nice to know how you get on, although I appreciate of course that it would not be wise to share that information during, when it is all over it would be good to know the result.

surely the fact that you have only been together for one year with no children should have some bearing?
