Hi There,

I received by email, a scanned copy of this letter on Coop letterhead in colour and signed by two people (Teamleiter Immo-Services Team and Liegenschaftsverwalterin).

Bitte entschuldigen Sie die Unannehmlichkeiten.<unquote

Rough translation.

<<The threat of prosecution of 15 February 2012 is invalid. Your customer account has been cleared and you have open positions as of today no more.

We apologize for the inconvenience >>


Would this be ok and I can rest in peace from Coop?

The letter itself is OK (get the original!). From the scan that you had attached to an earlier version of this post, I saw that it was on letterheaad of "Coop Genossenschaft - Direktion Immobilien". There is also a "Coop Immobilien AG" at the same address, whose CEO is the very same person who is head of "Direktion Immobilien", and they share other staff as well.

Which of these is your contract with? And which of these issued the Androhung? If it's "Coop Immobilien AG" and not "Coop Genossenschaft - Direktion Immobilien", kindly ask them to use the correct letterhead.

I thought that I deleted the earlier post with scan of the letter as I didn't want to get into problems.
The letter that you saw is on Coop letterhead and from same group of people who have been in contact from you since I had quit this Coop appartment. The letter is with colour ink and so, when I print it it will look like an original letter.

The betreibungsandhrong (debt-threat) letter was issued from this address. Coop Immobilien, post fach 3027, Bern. There is no name in this letter ... only the address.

Coop doesn't wants to close this issue and if I ask again for a letter, they will tell that they already sent it by email (scan in colour ink). I don't know what more to do !!

1) "Scanned and printed" isn't "in writing" under Swiss law. They had money to send you the Androhung, they can send you the Quittung.
2) The name of the legal entity you're renting from should be in the footer of the Androhung and in your contract.

Don't let them mess around with you. They're in the wrong, they know it (as per the scanned letter), and someone probably has had to explain to two people who have signing authority that s/he screwed up. So that person is in a bad mood.

Hi

The registered letter carries only the address and not the name of the person, who issued it. One of the signatories of the letter was the lady who I was in contact with and her boss, is the another signatory.

I will ask Coop to issue me Quittung tomorrow and also request them to send the letter by post. If they refuse, then I can make this demand by registered post to the Wangen address ... more than that I don't know what to do... I thought with the signed letter that I received, the problem is solved ... doesn't seem so.

By the way, my rental contract reads thus Vermiter --> Coop Immobilien AG, 3027, Bern and Vertreten durch: Coop Immobilien AG, Industriestrasse 17, 4612 Wangen bei Olten.

So your landlord is Coop Immobilien AG. You should tell them that they should use that company's letterhead, not that of some other legal entity. That level of attention to detail will probably scare them enough to send you the letter without further faffing around.

I checked all the written communication records for the last 5 years and it was always from this source (letter head) --> Coop Genossenschaft - Direktion Immobilien.
By nature, I don't want troubles and not really interested in pushing Coop to the wall unless absolutely necessary. I will ask Coop tomorrow to send me a quittung, which seem sensible for me.

Update:


Following my request, I got this letter today by email (they will send the same by post also). It is signed by two persons – one SAP support engineer and another chief financial office. This time the letter was in English.

<quote> We declare the collection of a claim we sent on 15th february 2012 as void. The letter was sent by mistake and was annulled in our system. Your debtor account was squared off properly and there are no outstanding items on your account. We confirm that your name was never saved in any swiss register.

Kindly excuse any inconvenience caused by this issue

I hope I can consider this issue as closed. Thanks once again to all EF members who assisted me with suggestions as to how to handle this issue. I think, I hope I am now protected from Coop adequately
