Can't back out of migros klubschula ?

Hi all

I signed up for some lessons for migros German lessons but in between me registering and the course starting I've had a few hefty bills so asked if I could defer the Payment and class until later in the year but they are telling me that once I register and it goes over the 7 day cooling off period it's too late and I must pay!

I never recall an Internet agreement being binding. Are they just trying it on ?

I had a similar case, in that I signed up for German lessons at Alpha Sprachstudio and didn't attend them as I had some personal stuff going on. I tried to cancel them after 7 days but they said that I must pay. My husband tried to negotate with them for months, and after dozens of emails he finally got a credit. In the end, persistence and a knowledge of Swiss German did the trick

So sorry to hear that. On the other hand, I can see their side. They only have so many places on a course, and the budgeting/pricing is done on that number. People rarely join a course mid-way- so they would be short of one (and possibly many- as there might be other cases) student in the class.
I used to run residential for 6 students at a time, and once a student's parents cancelled at the last minute, and it completely threw my budget out of the window. Hope you can sort it out.

Same thing happens of course with holidays. What would they do if you found yourself a replacement for the course? Maybe an idea.

Wait, what?

Of course Internet agreements are binding. If they weren't, online shopping would be impossible.

Good luck with your negotiating but I'd advise you to start from another angle: this is definitely not a winning line of argument.

Their terms and conditions are quite clearly marked on the website and on the email confirmation you receive.
The percentage you are liable to pay for increases as you get nearer to the course start date. If you try to cancel near to the start of the course you are liable to 100% of the fees.

Seems reasonable to me. As Odile said places could be limited and they may have turned someone else away to give you a place.

Is the course really imminent? When I was trying to arrange a Klubschule course I noticed that they often filled up before the start, and then there was presumably a waiting list.

Why not post the dates and cost of the course here? You might just be able to do a deal with someone -- or with Klubschule if you find a replacement.

I once took an online assessment of my not existing German, the page was in German (only which doesnt help a person who cannot speak German right?) at the end the told me which level I would fit. Few weeks later I got a bill to pay for the course which I was signed up for automatically (?!?!). The only reason why I got out of it was that they changed the dates of the course and I used that to say that I cannot make those dates and since they change conditions I resign...good luck!

Thanks all. What bothers me the most is that all the information in the emails and the letters I got through the post are in German so how do they expect someone to know what it says is beyond me. I'm sure if I had refused to pay and it went to court I would win on the basis that I'm signing up for something I can't actually understand.

If you look at their website and change the language to English it only provides a few pages before it goes back to German. For a company advertising languages I expect it to be available in about 6 languages!

Still, there's no better motivation that Losing a few hundred chf so I've started the lessons now.

Well done for starting with the lessons. Viel Glueck dabei - and will hopefully really help you with getting on with life here

But really - I am not sure about this legal issue. If YOU sign a contract without understanding it, how can they be responsible? Never, ever, ever sign a contract you do NOT understand. Be it for a gym, apartment, course, anything. Ask a friend, colleague, neighbour , anybody with a good knowledge of the language to go through it with you- and only sign when you clearly know what's what. If you sign anything you don't understand, YOU are liable, I am sure.

I am sure you would not win as you signed by clicking the agreement if you didn't understand you had the choice to cancel and investigate before signing.

signing a contract and clicking a button is a big difference. the website is so woolley i could probably register you!

anyway, it is what it is now so i'll just have to suck it up

You have to be extremely careful about signing up for things in Switzerland. People here are great about locking you into giving them money, so unless you are OK with losing all the money in question… don't sign anything, or agree to anything online or over the phone.

It's so easy to say "Yes" and then receive a bill in the mail later. And if you aren't exactly sure what someone is saying or writing, it makes it all the more difficult!

can I take someones place at the Migros Klubschule

One of my friends today had the same problem. However I after doing the A1/1 course I have been doing some self study and I am at the same level as here and have the same book and everything and as she is suddenly going home she offered me her place in the class.

Do Migros allow students to swap if they are at the same level? I mean the classes are paid for and she wont be attending.

Which language would you expect to be used in court?

p.s. there's always a click you make to confirm your agreement with the general terms and conditions (even if you can't/didn't read them) by almost each and every online registration/order/purchase

FWIW I'm doing a course at ECAP and in Basel they let you cancel any time up to the end of the second week.

If you cancel you only pay for the classes you attended. After two weeks you pay the full course but can pay monthly.

Seemed good to me as I was expecting to pay the full course in advance when I signed up as it was only a week before it started.

Hi to all! I read the thread carefully and did not find the resolution, so I turn to you all for some advice.

In October I joined B1 1/2 in Klubschule Migros (KSM) Oerlikon really happy with level and teachers (my A2 was a mixed bag in KSM Alstetten). I renewed for B1 2/2 (when you are asked in class in front of everyone) and a few days after I renewed my mum was diagnosed with cancer and due to operate all in a very short turn around so I had to pack an go basically.

- I had to cancel the Thursday before the course started next Monday.
- I was 8th day, so 1 day after the cooling period (post buy).
- There was no waiting list, confirmed off the record by teacher: 14 spots, 11 students.

They have been chasing me for the money when I demonstrated (I actually sent proof) of my mums' illness and my travel ticket 24 hours turnaround between buying and flying.

The fact is that is a source of stress and I want to know what happened to people that had a similar experience, I have no access to Swiss German speakers, and the fact is that KSM does not seem to understand a logic emergency, is appalling. My mum is still ill and I had to quit my work to take care of her, so paying bill should be avoided. I have the savings, but is the principle.

Explain the situation, offer some proof and ask for a voucher. Sometimes this works.

Hi oly.girl: I did! Sent them even a picture of my mum with all the tubes in the hospital. They just said that "while they understand my situation, I booked and need to pay". The fact is that no one was left out of the course (no one was in a waiting list) and I offered to take the course in January, which they said I will also have to pay. Pay twice? I do not think so.
