How to remove a debt from the debt register?

Hi
Last year we got an invoice for my daughters final ABB Kinderkrippe payment. We paid it. Then they sent the bill again and my wife wrote to them and gave proof we paid it. Basically after 4 letters they never listened and sent round a debt collector. We paid it again that minute! Apparently there is an official document to contest debt but weren't aware.

We are now moving house and the new landlord asked the our debt file (can't remember the name) and when we explained the above he asked us to get it removed.

Anyone know what the name of the document is in german, what the process is, how long it takes etc. I guess if it takes long ABB could also write a letter to say we paid it...?

As far as I'm aware as long as you've paid it, it will get removed.

In my experience it is automatically cleared after a certain amount of years (5 rings a bell) but you can pay an extra "admin" fee to the company who issued the beteribung to have it removed. I'm not sure if every company will offer this, but you can ask.

Stupidly I had a medical insurance bill fall through the cracks and I got a betreibung, I paid an extra 80 CHF to have it removed from the registrar.

Urgent! help needed. I got a poursuite ( DE: Betreibung ) that I have no clue about!

This soul in Geneva says there is no record. So I imagine it varies by canton

Your local Betreibungsamt controls the register. To get the record removed you need to get the creditor to write to the Betreibungsamt and ask for the entry on the register to be removed. The creditor can charge you a fee for this, I read somewhere that Swisscom charge about Fr 50,--

If it was a private credit reference agency, in theory the same applies, the creditor has to write to the collection agency.

In both places, showing the receipts to prove you have paid, is now too late.

Search the forum for "Debt" or "Bills" there is plenty of information!

thanks for your tips, I appreciate this. I have enough info to go ahead now.

Is it a major deal in switzerland to have a debt like this registered? I mean, is it common to get new apartment rental etc rejected because of this. I guess it'll take a bit of time to get the debt taken from the register. Is there anything else I can do to mitigate this with the new landlord?

Clearly a school boy mistake has been made.

He/She claims to have paid it twice, but others are convinced otherwise, and insist it has never been paid.

Hopefully the OP still has either the post office receipts or bank transfer statements (they claim to have proof of at least the first payment), so it shouldn't be that difficult to show if they've paid or not!
But I agree, it's just possible they'd not got the final bill and confused a normal monthly bill with that.
Again, as long as they have the paperwork.....

If someone accuses you over owing them money and put your name on this debtors list (behind your back), are you notified of this?

Yes of course you are. You must reply with your written objection within 10 days. Otherwise the system proceeds.

If you have a debt write a detailed letter to the landlord explaining why, show that you paid it twice and are currently in talks with ABB to sort the situation.

A lot of people have debts, it's stupid but it happens. As long as they can see you took immediate steps to rectify the problem and don't have tons that are unpaid it shouldn't be an issue.

Regarding apartment application rejection, well I have had clients where the debt register wasn't "clean" and yes, it makes life more difficult, but of course it really does depend on the number of items, the amount and how old the entry is.

Some debt collectors will not remove the entry.

If your record is otherwise clean, if your current landlord gives you a good reference, then it is not impossible.

If there is a lot of competition for the flat you are looking at, then I think your chances might be worse. Whether the flat is privately owned or not may also be relevant.

Your best chance is to have it removed and considering the debt is connected to your employer, I would certainly follow the above suggestion and go to HR.

Hi
Thanks to everyone for their support on this. I spoke today to ABB Kinderkrippe today and they were fantastic. They will write to the Betreibungsamt this week (no charge) to get the debt removed and have also agreed for the landlord to call them directly if needed to explain it.

The new landlord didn't see any issues with it and feels happy that its an honest mistake with a solution in hand. It didn't seem to be a blocker for them as the guy mentionned that "if you get the apartment, you can just send the new documentation afterwards".

I'll keep my fingers crossed, but appreciate your advice

Does anyone have typical letter to ask for a debt removal from debt register? I only found a website offering these letters but they charge 80CHF. I know French, but I'm afraid I should use a very specific language in this kind of letters to make them agree with my demand.

You could also go and ask your "Betreibungsamt" (Office des poursuites?) about the procedures.
