HELP!! Got a Definitive Rechnung 2006

I have been having big problems with my tax forms and getting myself in order with everything. Most of all because I dont really understand anything of the tax system. Basically, when I got here, I claimed I was makign more money than I actually was, and now I have ended up with a Definitive Rechnung for 2006 which says I need to pay 7,800 CHF !!!! I dont think I even made enough money to need to pay half that amount.

Can someone give me ANY advice??? Is there any way I can turn this situation around? Because I honestly dont have enough money to pay that big a bill...especially as I didnt even make enough mney to have to pay such a big bill...

ANY advice would be most appreciated!!

Re: HELP!! Got a Definitive Rechnung 2006

you need to talk to the tax people.

and tell more about "how you claimed" to earn more than you do and remind us of your tax status - at source or as naturalised person?

Do you have an accountant to talk to?

Very unusual. There is a temptation to conceal income. You declared more income than you have?

You have 30 days to appeal the definitive assessment. You must be very cautious. Hope you did not submit construed documents with your income declaration. Then you are exposed to charges of document falsification "Urkundenfälschung", which is a very serious offense.

Get the best possible legal advice.

Sorry, I dont understand what you mean about "at source or s naturalised person"???

No, I dont have an accountant to talk to (If I did, I dont think I would be in the horrible situation I am in now ). I got an accountant to do my taxes...at the end he never contacted me (after I gave him all the receipts) and I actually had to call a friend of mine to chase him and get all my documents back!!!

I declared I would make more because my boyfriend was afraid with the really low income I made, they would not let me stay here in Switzerland. I must have declared I would make 30,000...but it says my "Faktoren steuerbar" is 65,000. I would NEVER declare I made THT much money. How on earth did they get a number like that????

Re: HELP!! Got a Definitive Rechnung 2006

But you must have a copy of the tax declaration you submitted, no? There you should be able to see what your taxable income is. Start with digging that one out and then take it to a reputable tax advisor.

Re: HELP!! Got a Definitive Rechnung 2006

And something else - why did you do a tax declaration in the first place? With that income you shouldn't have to unless you are Swiss, have a C permit or are married to a Swiss, someone with a C permit or someone with higher income than 120'000 CHF.

I am not sure what I filled out when I got here...my boyfriend at the time(who is was NOT Swiss, and probably had no idea what he was doign either) helped me out. The only thing I can really remember is declaring my income at the SVA, as I was self employed. Is that the same thing???

Re: HELP!! Got a Definitive Rechnung 2006

Aha! Then that is a quite different issue. You really need to talk to an advisor. Could it be that it isn't a tax bill you have received but rather a bill for AHV?

Re: HELP!! Got a Definitive Rechnung 2006

Î found my old SVA forms and bills. There it states I was estimated to make 29,500chf in 2006. Surely the tax on that cant be 7,800 chf. And where does this apparent salary of 65,000 chf figure into all this????

Maybe they didn't recieve a tax declaration at all and estimated that this is your tax debt.

No...I pay all the bills I get from the SVA for my AHV. The bill I just got says " Staats- und Gemeindesteuern 2006 Definitive Rechnung". That says that my "Geschuldete Stuern" is 7,800 chf, and that my "Faktoren Steuerbar" is 65,000 chf.....?????

Re: HELP!! Got a Definitive Rechnung 2006

YES!!!!! That is it!!!! I dont think I actually DID a tax declaration....does that mean I have to pay this amount???? Even if my salary is estimated as much less???? And the SVA has the figures???

I feel like a total idiot now. And I know I should have declared my taxes...

Ok, so at the SVA you _estimated_ that you would make 65K but in reality you made 30K(?). You really need to find an accountant to fix this. But you are correct that this might effect your permit. Be prepared to tell them that you are working hard to get more business. You need to dig up ALL the paper work you can, including receipts, invoices, etc & for anything and everything that you might be able to deduct.

You might have a problem if you can't document how much money you made so you won't be able to prove it wasn't 65K.

No, I never estimated 65,000. I dont even know where that figure came from. I estimated 29,500 chf for 2006. However, I dont think it should affect my permit now, as I have a B permit, and a good job now that pays quite a good salary, though I do not work 100%.

I guess I could find all my paperwork for 2006 to prove I did not make 65k.

Ok, I see that I read your post wrong. You estimated 30K... Is this not AVS contributions? I think Lob probably has the best advice: Seek a tax advisor. Then let us know what you found out! Good luck!!

The CHF 65'000 could be the scaled up annual income, e.g. you estimated CHF 29'500 during 5 months (August to December?) and that might be divided by 5 and multiplied by 12 to calculate the equivalent annual income.

Difficult to understand how a guessed anticipated income can be the basis for a definitive assessment?!
