Updates:

Just got reply from BonusCard.ch AG:

"The Libertycard is the renewal of the old SBB-VISA-Card. All customers who didn’t cancel their VISA-Accounts on time received a Libertycard which was for free for the first year after receipt.

Please note that the annual fee will not be cancelled in case of an immediate cancellation. To avoid an annual fee, you should send a cancellation request at least two months before the expiring date"


The Libertycard and the SBB-VISA-Card are different credit cards. How come they renewed my SBB CC to Liberty CC. Seems they can renew an apple to an Orange...

According to their condtitons and terms, they have the right to not to renew my CC. Now they tell me that not renewing my CC does not mean a termination of my contract. It is a must that the customers cancel the accounts.

The only condition on their contract may related to my case is:
1.6 Card expiry / card renewal
The card together with the associated additional services expires at the end of the month/ year shown on the card. If no termination is requested (cf. clause 5), a new card will be sent to the cardholder promptly and automatically. The issuer reserves the right not to renew cards without stating reasons.

I just forwarded their email to BFK. Don't know what suggestings BFK staff will give to me.
I am sure about this: Bonuscard.ch AG is playing their customers.

According to this article which discusses another somewhat similar case, there was actually an interesting clause in SBB cards' original conditions:

"Der Herausgeber behält sich die jederzeitige Änderung dieser AGB vor. Änderungen werden schriftlich oder in anderer angemessener Form mitgeteilt und gelten als genehmigt, falls die Karte nicht vor Inkrafttreten der Änderung dem Herausgeber zurückgegeben wird"

That's what allowed them to change your contract arbitrarily.

The article goes on to mention that such a clause may be illegal due to UWG, Art. 8, as your lawyer already told you. But it'd be up to a court to examine the AGBs and confirm this. There's a risk the court won't rule in your favor, and then you'll owe them and the court a lot more money than they ask you now for a yearly fee.

When they have such a ABG ...and get MY CHF from MY pocket using this....
Is that term a veeeeery deeeeeep trap for customers who trusted them?

This is something a lot of consumers fail to understand. Cancelling a credit card is not the same as closing your account.

I had to use their customer service a few times and i found them really good.
I have started using it also, and got good experience. I am pretty sure they would be reasonable once you explain to them that you clearly have never used the card and have no intention to use it either. But pls let us know of the outcome!

I sent the following to them on Friday, letter acknowledging cancellation arrived today.

Sehr geehrte Damen und Herren

Hiermit möchte ich meinen Visa Karte Liberty kündigen.
Da der HalbTax und die vorige Visa Karte nicht mehr zusammen sind und ich die Visa Karte nur genutzt habe wegen den Halbtax.
Ich habe bereits Kreditkarten und die reichen mir aus.

Dank für Ihre Bestätigung
