Nope. He has to proof it was send.

Same when ordering a package in a store, it is your problem if the package goes lost.

I have been a customer with ZKB for quite some time (and SHKB before that).

I think I got asked about this at some point, during a meeting.

Usually, when there was something to sign, they setup a meeting. It helps that one of their bigger branches is about 400m from my office.

I'm really old-fashioned in this regard: I like companies that have offices that I can go to in person.

It did not, nor did it say anywhere it needed to be sent back before a certain date. But I am not here to argue about what went wrong (I don't know why everyone feels they need to keep on repeating I should have sent back the form); I just would like to hear if it would make sense to change banks. From what I read here, most banks would probably have acted the same, so it wouldn't make sense. I am still considering this option though, because opening a new account as a (now) non-US person would probably free me from all the FATCA-hassle in the first place.

I would guess people keep repeating it because you keep repeating that they should have called you.

As to your question, I and others have given our view. Gbn put it in black and white above. What more do you want?

There are a lot of bank employees that are overwhelmed with the intricacies of FATCA. Call the bank again and let them know you are no longer compliant to FATCA stipulations. If needed, sign a document that ensures you are no longer under the jurisdication of the US and its tax laws and your account needs to reflect this.

As mentioned in many posts above, banks dislike dealing with American citizens unless there is a potential to make a profit. FATCA has caused American citizens abroad to become discriminated due to the hassle of dealing with US agreements, tax laws, etc.

This is correct. CS is one of the few banks that still accepts U.S. clients in Switzerland, so (theoretically) they know what they're doing with the paperwork.

If you try to switch banks, once they hear you've been in the U.S. recently they might panic and think you have to comply with FATCA, which starts the ball rolling again. It's not worth the hassle, imo.
