You should write them a letter that you demand the 0% VAT to be redrawn from your upcoming orders.

It is still a bit confusing for me. Can someone reply with yes/no to "If I order something from amazon.de and the price already includes the Swiss vat as the shipping address is Switzerland would I have to pay any extra fees (duty/customs)?"

Some replies imply no - the price you see on amazon is what you pay - but not sure here? I moved here from HKG which was really easy as they don't have vat, or customs/import duties at all.

Concretely for amazon.de when I am purchasing if the final price is discounted for the % of german vat, I go on with the purchase. This normally coincides with added Swiss tax.

If not, I do not buy it because I am not convinced they are within the system of dealing with taxes properly and don't want to be bothered.

Never had problems so far with this strategy.

It depends if the seller is Amazon themselves or a third party (market place) seller.

Amazon themselves charge the Swiss VAT and not the VAT of the platform they are selling from.
Their price includes all customs charges. You should see the final price on the last page when you click to pay/confirm order.

There are then some market place sellers who have an invoicing system or a signed up to a part of Amazon that recognizes that (let's say for amazon DE) the German VAT does not have to be charged for delivery to a Swiss address and so the VAT is 0%.
Whether your shipment is stopped/charged for separately by CH customs will depend on the total amount of your order and if this is over the limit. This has nothing to with Amazon.

There are then other market place sellers who will just send you the stuff and you can't see whether or not there is German VAT included at the Amazon checkout. You may see it on any invoice after ordering that the seller may provide you. Here they may have charged you German VAT or no VAT. It is quite unlikely they will have charged you Swiss VAT as they are not obliged to do so. Again with these orders: whether your shipment is stopped/charged for separately by customs will depend on the total amount of your order and if this is over the limit and has nothing to do with Amazon.

I ordered something from Amazon.de and chose the "exchange guarantee" option because it says that:

"For your convenience, Amazon will estimate and collect the Import Fees, which will be displayed in the checkout as “Import Deposit Fee”, but will not be subject to any refund.

You will not be charged any additional fees if the actual Import Fees exceed the Import Deposit Fees we estimated.
"

This part is very clear as you go through the checkout process.

Then I was anyway charged the usual blood sucking fees by DHL. Upon further enquiry, it seems that, buried somewhere in the help section:
"For items purchased from third parties and selling partners, the guidelines of the respective sellers apply. Import Fees for orders not fulfilled by Amazon will need to be resolved between the seller and their carrier of choice."

Now I think that if the first quote appeared during checkout and the second quote is buried somewhere else, then it is misrepresentation!! So beware....
