There is much among the replies to his query that is wrong and/or misleading. For one thing one can force a decision by HMRC as to its view of residence and domicile. Normally upon departure one files P85 to get a determination of PAYE: that can only be done after leaving. There are guidance notes on residence and domicile that explains the rules https://www.gov.uk/government/public...nce-basis-rdr1
Robert Gains-Cooper wishes what you said was 100% accurate.

Odile, there's nowhere left in the south of France that is not full of Brits, but we don't mind as long as they like to buy wine!

We will do the same thing as we did here, i.e. assimilate and make friends of whatever nationality. Actually, I hope there are a lot of Brits who come to the vineyard because then I can stay out in the vines working and the OH, who only speaks English, can do the tastings!

Re: What will happen to our assets when we kick the bucket

Got several friends making excelllent wine near Montpellier - one Swiss, a famous architect who gave everything up for making wine at Pic Saint Loup- and 2 of our ex British neighbours, whose mum is French. Bonne chance. (it was of course tongue and cheek - but I must say I prefer to be in a region where there are not 1000s of expats...)

I was speaking to my wife in English & some Brit hater French started being rude in English saying we should go home after BREXIT. I replied in French that I detested the English who did not speak a word of French too, & hoped that after BREXIT we would see the return of the French Onion man on a Bicycle

For the moment, our adult kids, both dual nationals, still live in the UK where they were born and bred. What would happen re taxation if and when they inherit our assets in CH, financial and property, if they are still in UK at the time.
Becuase you are Swiss you have to follow the Swiss inheritance laws.

At least 50 percent of the estate to the spouse/registered partner
At least 75 percent of the remaining half to children (and grandchildren)
If there are no children or grandchildren, parents are entitled to at least 12.5 percent.

Better you consult a professional

'kids had to sign the Pacte Successoral' so it looks as through Odile already did.

Re: What will happen to our assets when we kick the bucket

Thanks FMF - we did seek professional advice, and took the right steps to ensure the surviving spouse will get 100%- the Pacte Successoral does that.

Re: What will happen to our assets when we kick the bucket

Inheritance, in most cases, is taxed where the deceased lived at the time of death OR (in some cases) where he used to live x years before death. The "x", in some cases, depends on nationality.

The inheritor is, in most cases, not taxed, or taxed only if the country where the deceased lived doesn't levy any taxes.

In Switzerland it's by Kanton, for example Kanton Schwyz has no inheritance tax whatsoever. That is, if the deceased lived in Schwyz.

If you inherit something while living in Switzerland, there are no taxes whatsoever. It depends solely on where you're inheriting from.

Depending on your wealth, you might as well consider a foundation to manage your legacy; such as a foundation in Liechtenstein. The foundation can optimise some tax issues for you, but costs approx 18k/year to run.

So you'd have to look at the interaction between you Kanton's taxes and the corresponding UK's laws.

Re: What will happen to our assets when we kick the bucket

A couple of general question about wills.

One option is a hand written will dated and signed. Must this be in the local language(s) of the particular canton - or can this be in English or another language.

Is it possible to write out your parents (non-swiss, non-resident) without their agreement or involvement?

You may write them out. But unless you claimed Heimatrecht (inheritance law of your country of citizenship shall apply), or you have no kids, if the parents are not happy with what you did, can claim a just share (Pflichteil) of the inheritance (which can be paid in cash by the inheritors).

The parents can claim (they have to claim, this right is not automatic):
No kids (or grand children), no surviving spouse/registered partner: 50% of the estates value.
No kids, surviving spouse/registered partner: 12.5 % of the estates value.
Kids (or grand children): 0 %

Hand written wills can be drafted in any language, while wills made before a notary are usually in the local official language.
