Quick tax question (sole company + full employment)

I'm working in Zurich for a company based here, my husband is working from Zurich for a EU company (he's sending them invoices, starting 1st December 2018, but his salary for 2018 is below the minimum taxable amount, below 2300 chf)

1. Do we have to fill our tax return this year, even though we worked here only 1 month in 2018?

2. If yes - should we declare my husband's salary from his sole company?

3. Is there no "tax free amount" when you're filling the form jointly?

4. Is filling jointly and declaring his earning enough, or for sole company you need some more forms?

I didn't get my tax info from my work and it's March, so I don't really know what to do.

I'd appreciate any help!

Re: Quick tax question (sole company + full employment)

Call the tax office of your commune and/or canton. They are helpful people.

For the issue with your employer:
- Request an extension to file the tax. Can be done online.
- Write a letter and request the 2018 Lohnausweis. Send the letter using registered post.
- Check if your AHV contributions have been paid! https://www.svazurich.ch/internet/de...lformular.html

Comments:

You: As an employee with a B or L permit, you are most likely subject to Quellensteuer (source/withholding tax). Although circumstances may vary, generally it may not be required to submit a tax return, e.g., if you are earning more than CHF 120'000 p.A., you normally must file a tax return.

See this brochure for more information (English):

https://www.steueramt.zh.ch/dam/fina...t_qst15_en.pdf

Sole company: generally, to be considered as self-employed in CH, a sole trader needs several customers. A legal entity, on the other hand, does not.
There are several options that can be considered for a sole trader with one customer:
1. Anobag: Swiss resident is considered an employee of a foreign company. S/he registers as such and pays social charges out of his pocket or has foreign company pay the charges.
- Search the forum on Anobag for more information.
2. Payroll service: registration with a payroll service/ temp bureau such as Adecco, Manpower, etc. The payroll service is then the legal employer.
3. Set up legal entity.
4. Add customers and apply for self-employment status with SVA.

Re: Quick tax question (sole company + full employment)

Thank you for such detailed answer!

We're on B permit, I'm taxed at source and literally now I got my year-end certificate (Lohnausweis?) but that's mine, what about my husband's?

On my husband "company" - Anobag is not an option (his employer is not really an employer, it's a contractor), also he doesn't earn the minimum wage so they won't accept his contract, same with payroll company, we contacted them, it's not possible with such amounts.
We're trying to get accepted by SVA but no info yet, he has one bigger client and two others time to time, but as I said - we didn't receive their decision yet.

"Request an extension to file the tax. Can be done online. "

To fill the tax return I need some special tax number other that AVH, am I right? Can I ask for extension even though I didn't get the number?

Also - I'm pretty certain that we have to fill the tax, because of my earnings and the fact my husband have to pay his taxes somehow.

So, you did not get the tax forms yet?

Call the tax office of your commune and/or canton. They are helpful people.
Request the tax forms because your husband is self employed. Then fill in the relevant boxes etc. specially those on Hilfsblatt A.

Once I heard from a lawyer during a public info session that the "IK-Auszug" should be ordered with care. There are some potential side effects, which I do not remember exactly.

Something like, if there is anything wrong, one needs to report them when they get their first IK-Auszug.

Re: Quick tax question (sole company + full employment)

Once you receive the IK-Auszug you have 30 days to object to any errors on it (https://www.ahv-iv.ch/p/1.01.d, p. 4). You can still object later but will need to provide full proof.
