Mandatory Portion of Inheritance Calculation Switzerland

I am struggling to work out the formula to calculate the mandatory (Pflichtteil) Portion of an Inheritance.

I have two children and I am busy doing my will and due to the fact that one of my children has given up her job to look after me, I would like to ensure that she is compensated for this but I also want to ensure that my other child gets the mandatory portion of the inheritance but I don't know how to calculate what the mandatory portion would need to be?

I am hoping that someone can help me work out what the mandatory portion would be if the estate, after all costs leaves CHF 10'000 to be divided.

I am single and have no husband to consider.

Re: Mandatory Portion of Inheritance Calculation Switzerland

Simplistic calculations:

No spouse. Children get equal share. Of which 3/4th is minimum.

So each of the 2 children has a minimum portion of 10000*1/2*3/4= 3750
Free choice portion = 10000 - 3750 -3750 = 2500

Child 1 gets 3750
Child 2 gets 3750+2500=6250

I am not a lawyer or expert, this is my understanding.

You could write in your testament that Child 1 gets Obligatory portion and Child 2 gets Obligatory portion plus all the Free portion. This will save having to put down numbers etc.

Thanks Dutch. I am making my one child the executor to save costs and I am worried that she won't be able to work that out. I can see you are a boffin in mathematics. Can you perhaps help me put into an MS Excel formular if that is not to forward to ask?

Don't name specific amounts in your will since your capital will change over time, just name that each kid is entitled to their by law defined minimum part and that the remaining part goes to "fill in whomever you please"
