Betreibung or debitor list

Hi. I had a consultation with a lawyer here in Swiss and for four mails exchanged he send me a bill of 750chf.

Is it possible to contest it? Much important, can I be added in the list of bad payer or "Betreibung " if I do not pay?

Well first of all they did not charge you for four mails, they charged you for the time it took to consider and research the matter and then write the letter. So for a couple of hours per letter as you call it, I'd say it was not unreasonable.

What had you agreed upon before exchanging those mails? Odds are the lawyer mentioned fees at some point.

Yes, if you don't pay you can wind up in the debt register.

We agreed at the phone an hourly rate.

Besides only agreeing on an hourly rate you should have mentioned something like a max of 2 hours, or a warning when exceeding 500,- (or whatever amount you deemed fit) that would have given you the option to walk away when the bill becomes too expensive for your budget. And likely leaving you with an unfinished job.

750,- for 4 emails and the research/time behind it seems pretty fair to me for a lawyer, so unless you want trouble it be wise to pay.

You can try to contest it but my guess is you will lose, esp. since the lawyer is probably far more experienced in such situations than you.

You'd only stand a chance if the rate you agreed was somehow very low (e.g. under 200 per hour, which may be a first in CH), and the lawyer has visibly inflated his hours. Hard to see that really.
