Opfikon municipality wants a deposit for 2020 tax ???

Hi guys,

I am leaving switzerland at the end of the month, so today I went to the municipality of opfikon to do the unregistration.
They said to me I have to do the tax declaration also for the year 2020, and until here, it is fine.

After they said to me that I needed to leave a deposit of 2100 chf before leaving, otherwise they would not have done the unregistration.

I have the B permit, so every month taxes are withdraw from the source with the right percentage... I really do not understand their request.

May be they are afraid I am leaving and I will disappear in case I should pay something else... but I don't understand if it is legal to ask something like this, a preventive payment for something that it can happen.

On the other side, I do not like that they take this amount for one year or more.

Do you think is it legal? When I asked them to give me the law giving them the right to do this, they didn't do.

What do you suggest in case?

Hello Tom, thanks for your reply.

"Normal" is opinable , I've been working in 5 different countries , and the procedure was totally different.

But what is more important is the "legal" part.
Do you have a document or a reference or something that is confirming what you say ?

How can I be sure of that ? How can I check it ?

Option A
Complete the tax declaration for 2020 (up until the last day you will be in Switzerland) before you leave Switzerland.
Take it to the tax office with papers showing you're leaving.
Ask for a final tax bill.
The tax office then compares the amounts that have been deducted from your salary monthly up till now, with the tax form.
If they calculate that you owe more than you've already paid, pay in that amount.
Take the receipt back to the municipal office where they will then do the deregistration.

Option B

Wait until the regular date for submission of the tax form, after 31.12.2020. Do the tax declaration then.
At that point, the tax office will compare the amounts that were deducted from your salary monthly up till you left, with the tax form.
If they calculate that you owe more than you've already paid, they will take that out of the deposit of Fr. 2100.
They will then send you the change.

I tell my experience, because I think it could be useful for other people having a similar issue in the future.
My solution was similar to what you proposed in option A.
I wrote them 4-5 mails, talking with them about the right they can ask to pay a deposit like that, without justifying it clearly.
They sent me their details/calculations, I sent them my calculations with all my payslips, and at the end the amount to pay was 10 times less...

I have to say that at least they were open to do a revision of what they were claiming... I appreciated that

181 of the Zurich Tax Code gives the tax authorities the right to request security for the tax they consider owed if they fear that they cannot collect the taxes (https://www.steueramt.zh.ch/internet...pdf/StG-ZH.pdf)

On the other hand it is doubtful whether they can refuse to deregister someone unless they've paid their taxes (http://relevancy.bger.ch/php/clir/ht...=show_document)
