13th salary question

Hello to all ,

I have 13th salary and it's stated in my contract that it's paid pro rata for part-years served , in two equal halfs, with June and November salaries.

Now, if I would like to resign , and my last day in that company would be
31th of May , would I :

* receive my first half of the 13th salary with my last salary in May

* or I would not receive first half of the 13th salary as I would not be in the company anymore while the first half would be payed out (month June)

* or I would receive that first half of the 13th salary with my last salary but it would be reduced by % proportional to 1 month as I would not be in the company in June

Depends on the exact wording of the contract. Most often, 13th salary is a "guaranteed" part of salary and so you should still receive pro-rata portion of it.
If you leave one month before that part is due, you should get 5/6th of the amount that would have been paid out in June.

I'm sure you must have your reasons for wanting to resign, but right now I know several people who had planned to resign but are shelving those plans, so they can make their decisions only once things become clearer, and then based on whatever the new reality turns out to be.

You earn 1/12 of the annual salary each month but only 1/13 is paid out. Thus 1/12 of 1/13 of the annual salary accrues each month, with the balance usually paid on two dates (usually June and November, what's accrued in December gets paid out beforehand in November).

What has accrued but not been paid out yet is due when your contract ends. In your example you're due in May, in additon to your monthly salary, 5 * 1/12 * 1/13 of the annual salary (five times because by May you've accrued five monthly portions of the 13th salary that haven't already been paid out).

The 13th salary is not a bonus, it's part of your ordinary salary, just the payout is a bit unusual. Your salary can not become void or be forfeited (probably unless you explicitly agree).

But as has been said, now is a very poor time to quit, it's almost certainly advisable to stay at least until 2021.

Usually it is easy to consider you have a total yearly earnings which are divided by 13.

Take your yearly salary divide by 13. Then what you will get at the end of May will be that figure, divided by 12 and multiplied by 5.

Of course this is generally speaking, maybe your contract has some wording in it which may alter this. The only thing that may happen in your case I can imagine. Your 13th month and possibly any bonus etc, it may be paid out when everyone elses 13th month is paid out in June, so its possible you have one more payment after leaving

In general and usually: The 13th salary is part of your agreed annual salary and paid unconditionally. If this is the case, you have a pro rata entitlement if you leave before the annual or biannual pay out date. With the last paycheck all dues are paid, including your pro rata 13th salary.

It would be very, very unusual and out of the ordinary if it were not like as described above.
