Income tax refund

Hello, I hope someone can point me in the right direction.


I was working in Switzerland in 2019, but was on "garden leave" for 4 months. Once "garden leave" had commenced I returned to the UK and informed the local authorities in Switzerland at that time.


I continued to pay Swiss Tax until the end of my "garden leave" although no longer living in Switzerland.


My question is; can I ask for a Tax refund for the period between leaving Switzerland and the end of my "garden leave" 4 months later as I was in the UK?

No as you were in theory working in Switzerland.

If you are earning money you will be tax resident somewhere. Most likely it was the UK, so at best you'll be entitled to a tax credit against UK tax liability for that period.

If for some reason your tax residency remained in CH, then of course there's no refund.

They will be paying Pillar 1 / 2 plus accident insurance for an employee, the fact that they don't come into work is irrelevant, they are paying the notice on a Swiss WORK contract.

But if they're in the UK for those three months, then that work mabye/will be deemed by HMRC to have taken place in the UK. Probably best for the OP to keep quiet.

There is no "work" so where the (no) work is done is irrelevant, same/similar as if you went on vacation, However it'll depend on how and when the OP is deemed tax resident in each country and it can get complicated.

If the UK decide to tax it, it could very well be that you'll need to request a refund from the Swiss.

UK tax will likely be higher as the Gross pay rather than net pay is taxable also without many deductions assumed if you have a B permit. (Pillar 2 would be deductible in the UK but thats all)
I suspect he will be dual tax resident so will get a credit for Swiss tax paid against the UK liability, I doubt the Swiss would return it especially as social contributions are being made in CH.
