health insurance broker forged my signature!

Hello ef! thanks for any help you might give me about this

The story is that my wife met a health insurance broker (we want to change health plans). After our meeting my wife didn't sign anything but the broker insisted she sign a document that was something along the lines of that my wife had been informed of specific health plans by the broker.

anyway fast forward a couple of days and we discovered that not only had the broker forged my wife's signature to copy onto health-insurance forms to sign her up with an insurance company, but also get this he had totally made up a signature for me and signed me up for health insurance too, including optional extras! he'd never even met me, i wasn't at the meeting, and wow what a wildcard.

signing my wife signature seems extremely daring and corrupt but making up my signature seems totally reckless tbh.

anyway that's the story and i thought, well if anyone can give me some advice it's ef.

what's my next move do you think. basically what would you do if you dont mind me asking. are there for example specific regulatory bodies that i should contact or this just general criminal behaviour?

If what you say is correct, it constitutes fraud and you need to report it to the police.

This.

Even if you have managed to get yours cancelled chances are heís done the same to others and he needs reporting.

On the insurance side write a registered letter were you explain the situation and that neither of is bound to the contract as you never actually agreed, nor intended to agree, nor implied to agree, nor signed it, nor ordered anyone to sign on your behalfs. Or in other words it lacks the very fundamental core of a contract: Art. 1 Code of Obligations.
Note: You might send two letters, one for you and one for the contract of your wife. Or send only one letter but both should sign it. And as said use registered post.



On the broker side you should file a complaint with the police.

If the consequences of signing someone else's signature that is the crime... fraud in this case.

I think it's great that most of the replies are apparently believing the OP, but frankly I'm surprised. Does no-one think there's something a little odd about this - an insurance broker committing a serious criminal offence just to meet his quota and get his few francs of commission? Seriously?

What motivation the OP may have for posting a false story, if it is, I really don't know, but we've been seeing a bit of a glut of complaints of this type recently, and many of them don't altogether ring true.

Even if it is true, why the OP didn't run to the police, it is obvious this is a crime.

Do people really need advice on public fora about what to do when they are the victims of a crime?

For many months now, it seems there are a lot of posts that seem pretty clearly to be done to stir-up the ant hill. And it works so often, it is truly surprising. Are we really this gullible on our forum? Or are we just really bored, complicit to entertain these posts?

Originally I was thinking it was a few of the regular malcontents with several accounts. But now, I am going to put on my tin foil hat and wonder who benefits from all of these posts (website hits)? The owners of the forum! Guilty I say!

*probably not really guilty, but it seems more fun than to think it is the same few malcontents over and over again.

**I should have made my rant a post.....think of the ruckus that could cause.

Itís not the first time Iíve heard of this happening and I know of at least one broker who was fired for this very thing. I donít know if he was prosecuted or not though.

Hi OP, can you please name the broker or at least the company he is working at... I understand this maybe a slander ... but if you proof your case, please share.

I too just been talking to youngish broker, who was very strange, I thought it was the Swiss way, like threw a tantrum when I questioned some of his proposals, and took too long to actually put the paper work through, however my supplementary insurance deadline already passed yesterday and he still hasn't done the cancellation plus applying for the new one, I tried to call him yesterday, but he mailed me saying he is at school and I should appreciate that my insurance would take a long time to process I sent him an email yesterday saying well, if he failed in having all paperwork done by deadline yesterday then count me out, I know this is not official way the Swiss would do it, but am in moving homes and don't have time to run around post offices sending registered letters yet !! I am dreading what they guy did / will do .... I sent off a cancellation to Sanitas myself as I am for sure not happy with them walloping me so much extra just for moving homes.

Your next insurance will do the same.... You may not like it but it works like that, premiums based on your postal code.

hey guys and gals first of all thanks so much for the feedback.

i totally get that the internet has fried our brains and no-one believes anything anymore. tbh ive read plenty of posts on here that i dont believe and imo bonaire the answer is definitely that the owner of the website pays either directly or more likely indirectly (like via digital marketing companies) for posters to come on and post car crash threads to get everyone whipped up. it's tbh why i stopped coming on here so often coz i think there's a lot of 'being pulled around by my nose'. what i used to think were weird trolls posting rubbish i suddenly realised were like click bait for EF.

anyway, fair enough for all your suspicions. what can i say

btw yes we have got proof of all this. the insurance company has sent us the docs!

do you think btw there is legal redress here somehow? i guess this is also something i was alluding to in the first post, not very well mind, as well as 'just what am i dealing with here?'

btw Sandydown i will totally post the name of the company but first i want to go about things carefully and dont want to do anything wrong. also, following your story, another broker i did see had a small tantrum when i asked to take home all the documents that id sign so i could go over them first. he was totally unwilling to hand them over!

A bit surprised by this post considering this specific behaviour has been discussed also in national television back in 2018. I don't know how much money they make but I doubt it's a few franks, and these "brokers" (to distinguish from real brokers) are horrible people but also as smart as their victims so I doubt they always know what they are doing. What is also surprising is that it is resurfacing, meaning insurance companies have not changed the way they work except cancelling contracts with more ease in these cases.

tbh i couldnt believe it either. it was so wild! i also thought that it cant be for the money coz he'd likely get fired once it all came to light, so it seemed just so reckless.

my last post wasnt a diss to anyone at all, in fact i was saying i empathise not believing it, coz a lot of posts of ef it seems are made up and i suspect its to get more people watching reading commenting. the internet has fried all our brains, look at the facebook! no-one believes anything anymore just saying, not dissing.

anyway more crazy broker stories: another broker we saw in fact signed my wife up to a different thing than she thought and its not the end of the world or anything and it comes to about 5chf extra a month, BUT get this, this guy refuses to cancel it (the insurance company says he has to send something back and its not a problem their end). he starts lying a little bit on the phone, says he doesnt know where the original contract is, says he doesnt come to zurich anymore, then hangs up. like mega wow!
