Shop open on Sundays, is it legal?

Hi,

I have noticed in Zurich a few independent shops, e.g. Halk Pazari Oerlikon, that are regularly opened on Sundays.

I thought this was not allowed, or maybe the rules have changed because of covid...?

As you know, rules are often K/Cantonal. Here in NE- independent shops can open on Sunday, as long as they wo/man the shop themselves- eg owners- so they do not pressurise employees to work.

Maybe.
There are specific rules around employers allowing family members to work in a family business, but I feel this may be more likely as they are a food shop.

For the employer

Temporary Sunday work involves not more than six Sundays per business and calendar year, including public holidays, or Sundays work during a one-off period of three months maximum.

Temporary night and Sunday work must authorised by the canton unless the type of work is listed in Ordinance 2 to the Employment Act. Authorisation is given if there is an urgent need for the work.

Our 2 local shops are opened legally every Sunday- 1 in the morning, and one late afternoon.

I thought that Sunday openings were really taboo in CH, with the only exception of stations and airports, and in 4 years it's the first time I see it. Well, one never stops to learn!

Stores in Zürich can get permission to open on Sundays nothing specifically to do with Covid-19 and happening for years.

As I understand it, small family shops (in ZH) can open on Sundays as long as it's only the owner or immediate family staff working, they can't have non-family staff working. I've seen quite a few small kiosk type shops open every Sunday, especially in the Niederdorf area.

Opening hours are slowly increasing all over ... when I first moved to Zurich, most shops closed shortly after lunch on a Saturday as well as being closed on Sunday!
Now, our local Denner is open on Sunday as well ... although with part of the store blocked off (not sure why ... ).

Officially stores are due to Corona restrictions currently only allowed to sell essential stuff like food, drinks, hygiene, cleaning and such. Other stuff should be locked off for customers.

The Migrolino next to Sihlstrasse is open on Sunday (and most certainly not a family business), the Coop Pronto opposite it is closed. It's down to getting a permit (which isn't impossible to get) - plenty of backeries are also open on Sunday.

Migrolino is often franchise, so could still be a small family business.

Baker's are traditionally family businesses and staff are family- they have always been opened on Sunday mornings for 100s of years- same as the laiterie/crêmerie (milk and cheese shop).

Garages and railway stations have special dispensation.

All the shops where I live are open on a Sunday, including Migros and Coop.... I'm very lucky! It drives me nuts when I go somewhere else and they are closed!

Personally I am very glad that employees are not forced to work on Sundays and that their Unions are protecting them.

All the jobs I have ever had have required me to work Saturdays, Sundays and bank holidays. As long as I get days off, I don't really care where in the week they fall.

As long as it is a choice, it is fine. But for families who want to spend time together, have a meal together, go for a walk together, etc- mum or dad having day off on Monday is not much good.

True, but that's the petrol station isn't it? I know they can open, and for some reason they are allowed to sell everything else they have in the shop, including alcohol.

It's always a choice.... you take a job that involves weekend work... or you don't!! If you want family time at weekends, you don't go into a job that involves weekend work. Airport staff, train staff, ski instructors, doctors, nurses, police, hotel staff etc etc... how is taking a job in a shop that opens at weekends any different to these? When you take a job you accept the working hours.
