And no matter how very located in Switzerland UEFA are, no court has jurasdiction over who they allow or throw out of their own sporting competitions.

Again, that's what FIFA and UEFA like to think. They may be right. But seeing as they are neither some sort of World Government, nor have overlordship over Switzerland (yet), that's ultimately for the courts to decide.

Well it isn't, and they will only waste money in trying to interfere, which will only make matters worse for Sion.

Courts have no reason to get involved in sporting competitions. Otherwise every world cup in the past would have been the feature of legal appeals.

Well this is about to get really bad for Swiss football.

The court has again told Uefa to reinstate Sion. For every day they don't they'll be fined Fr1000. http://www.tagesanzeiger.ch/sport/fu...story/10553436

The SFV better get Sion under control otherwise Swiss football will be exiled.

In the end UEFA organises a competition and set the rules. Who is a private court to decide what the rules are to be? Are we gonna see athletes banned of doping going to the courts as well so they can still compete? For me its the same competition laws have been broken and they need to pay the consequences.

The courts have a reason, they were petitioned by the plaintiff.
No one is above the law... Not even FIFA
Everyone is entitled to a court hearing of their grievances.
if you believe someone/thing has acted unfairly against you , then you can ask a court to redress the situation.
The courts will decide the merits of the case and any issue orders.
Failure to implement these orders can result in contempt of court, which can get very nasty. Fifa could be suspended from trading and face increasing massive fines.

But the thing is UEFA and FIFA are effectively a club. They both set up rules and any country wishing to join these clubs had to agree with them. Clubs wishing to join their respective associations will have also needed to agree to these rules. one of which is that no club will bring action through civil courts. There is a court for these grievances but Sion has decided not to go to this court. They would much rather use local civil courts which is against the rules and statues of both organisations.

As a mentioned above an athlete banned because of doping could just try to find a court which will get them reinstated. Many of the banned aren't illegal, they are just against the rules.

This is absolutely correct - and whilst I would like to see more UEFA football in CH, Sion has gone to the "wrong" authorities. The Swiss Federation also screwed up - they allowed players to be part of the squad when the Swiss league had already denied this. Sion further screwed up by using these players in the Europa League

If Sion wants to plan in UEFA competitions they need to abide by UEFA club rules and should've appealed to UEFA court (where they would lose as there is already several precedents).

I wonder what position Zurich and Basel will take - they certainly don't want to be kicked out. They will pressure Swiss Federation to keep Sion "under control".... I see some money changing hands

I was talking about banned athletes above and funnily enough I just saw this story http://news.bbc.co.uk/sport2/hi/olympics/15196177.stm

This decision will have for athletics similar ramifications as the consequences of UEFA giving in to Sion. The main difference is this guy went through the right channels. Sion didn't even go to the sports courts cause they were of the opinion they'll lose anyway. Well Cas have today proven they are prepared to make major decisions against governing bodies if there are good reasons.

CAS takes ages to get to a decision. Sion want to compete this year, so they went to the Swiss courts. Remember the West Ham / Tevez Saga? Sheffield got compensation, but still went down...

That CAS takes ages to get a decision is irrelevant. They agreed to take any grievances to them. Anyway the reason Sion gave for not going to them is that they knew they would've lost anyway.

I remember the Tevez saga. It is dealt with by a FA tribunal. Sheffield threatened to go to civil courts but backed down once the possible consequences were clear. What is definite is that Sion will not be reinstated to the Europa League. They last game in the group is on 15 Dec. That will cost UEFA Fr71000 which I'm sure they'l much rather pay

...and it still drags on

well, i dont see celtic winning against udinese on thursday so i am hoping that CAS will enforce another 8 games (home and away to each club) for sion and cellic may just have another chance to get through

Sion are really trying to do everything to get the Swiss kicked out of FIFA and themselves possibly kicked out of the SFV. I some how doubt though that he'll have as much sympathy in Zurich as his mates in Valis had with him

It's about time the SFV grew some balls. They're like a kid curled up in the corner of a room hoping all the problems will go away.

The other teams are going to force the SFV's hand by going to the CAS to get the games where these players played in turned into a forfait loss for Sion. Link

Searching for the link above I've found the SFV finally found their balls. Link It's reported Sion will be deducted 3 points for every game one of their ineligable players was used so 30 points in total. This will put them bottom of the league 10 points behind second last place. The results will stand though.

It won't be the end of this though. Sion will inevitably go to the courts- where they'll lose

but I'm sure the CAS will order the SFV to turn lose games into forfait losses.
