soapbox on:

If anyone is so inclined, on the [advertise] button, this information for the site advertising director is readily available:

But what is REALLY interesting is the sites own "code of conduct*... *Note some content removed for clarity and space

Link Here: http://www.englishforum.ch/xtra/pages/termsofuse.html

Code of conduct

You understand and agree that THE LOCAL may review and delete any material or content, including but not limited to text, comment, message, photo or profile that in the sole judgment of THE LOCAL does not comply with this Agreement, applicable law or regulation, or which might be offensive, illegal or that might violate the rights, harm, or threaten the safety of other users.* ... It is very important that you report any illegal or inappropriate Contents that you become aware of to THE LOCAL or by clicking on ["Report Inappropriate Contents"].

and these "specific" items...
criminal activity such as drug dealing, trafficking, child pornography, fraud, obscene material, gambling, harassment, stalking, spamming, sending of harmful computer files, theft of trade secrets or intrusion of copyright or patent rights;
promote information that you know is deceptive or phony or promote illegal activities or conduct that is insulting, obscene, threatening, derogatory or slanderous;
provide instructional information about illegal activities ...*

And the Jurisdiction ????
This User Agreement shall be governed by and construed in accordance with the laws the Federal Republic of Germany, without regard to principles of conflict of laws, and the parties submit to the exclusive jurisdiction of the German court.

Note: It would be worth everyones attention to really read the above code of conduct link... In my estimation, based on this COC, most of the posts on this site would be banned, (in addition to the posters)....

soapbox off:

Re: Online gambling section on the EF front page

Fairly clear explanation that this is a breach.

Even though those conditions refer to German jurisdiction, it is actively promoting an activity in Switzerland to members primarily living there.

I am no expert on law but I think that German jurisdiction would not make much difference.

it is a terribly long one though. In short: Casinos are legal, but you need a license.
Is online-gambling already mentioned in the law? (sorry haven't read it)
AFAIK the Bundesrat has communicated the intention to loosen these regulations and to allow a few licensed "online-casinos".

If the law has not yet changed, I assume the list in this link is still valuable... eg. point 3, marketing activities for online-gambling (setting hyperlinks). Even if it were legal, I think the advertising space could be used differently.

Should we advise the police?

...sorry the links are only available in de,fr,it

As I have found out over the course of this past year, jurisdiction (at least for German Based Companies) is where the users are located.
My company is based in CH, however our users in DE do not have to conform to our current company "code of conduct", as the DE law has additional privacy concerns.

So the same should be true for us... No ???
Point: This is primarily a Switzerland based information website
Point: Most of the current users on this forum are living and/or working in Switzerland
Point; This is not the last controversy over this site, or its "new" practices. You can "bet" on that.....

My two cents on it. When we asked to remove the rep, groans system because of the drama it cause, they told us it was what Mark wanted.

I believe that what I see now, wasn't in Mark's plans...
Well, like it or not it's irrelevant. The Local own the Forum and have done for some time now.

Online drugs section on the EF front page

Well, at least I know now where I can advertise my CannabisZion site ("...a multinational website whose target audience is the entire world of online tokers. The goal of the site is to help people from all corners of the globe find trustworthy places to get good gear on the internet.")

I mean man, like, granted like, yes it is like illegal like in like Switzerland like, but it's not like they like enforce it like or stuff like that like, so it must like be like ok really like .

Oh it is clever... read the "article" - the poor lady did not know how to set daily limits, which is apparently not possible in the casino in Baden, but very much so in the advertised online casinos...

Seriously: the official Swiss governmental site jj muge linked does not really leave any space for interpretation - advertising foreign casinos in Switzerland - and one a .ch domain is "in Switzerland" - is explicitly illegal. Given that Wolli wants to arrest every smoker in a bar it can only be a matter of minutes till the Interpol SWAT team arrives at Gjörwellsgatan 28...

I personally do not like it when Mark is dragged into this type of discussion - nobody can possibly say what his opinion on this or that would be today. But one thing is for sure - he would have never left a thread like this one unanswered - and neither would have Lob, Nathu or any of the other people who administered this site in the past. I know this is a thankless hobby to say the least, some received quite the opposite of thanks for their work from time to time - maybe some people today think better of you guys now than they did back then...

As previously posted, this issue has been forwarded. As can be expected, when questions of a legal matter are raised, things slow somewhat. A response will be given once the issue has been investigated.

I think it's pretty obvious that the advert will go: even if it is legal, it's sailing pretty close to the wind.

They should at least give adverts that fit the demographic of the forum.

KFC home delivery and porn.

Didn't you read this? 48% earn more than 60'000 CHF... wait, isn't that slightly less than the average income in Switzerland?! Looks like a lot of you guys are in fact normal common people...

And my wild guess is that the management did not specifically chose gambling as the coolest topic on earth. Maybe advertisers are not exactly lining up to spend their money here...
