actually, the server is in US jurisdiction. I wonder if that's deliberate as I'm sure TT and EF were on servers in Germany for a long time.

if the location of the server is not important, why is EU Safe Harbor existing? Why did no Swiss (private) bank use Postini services until they were in Switzerland?

As Mathnut said, little will change but it'll help us Mods. The moment something is published online, you can be sure it's LOLCAT'd somewhere by someone before you know it. Or in a new website for expats in Switzerland.

I don't see any benefit of the Local opening a discussion on what they intend to do; emails arrive, which is about as personal as we can expect.

once posted, your data may appear to belong to an entity called Sky and it'll be indexed and cached on many search engines before the day is out.

so in the end, if the local does nothing with it, it's the same as before.

Sky is not really personally identifiable information to most people.

the server is in the US and the owner of the server has some ownership of the data (IIRC).

So all-in-all, whatever the T&Cs, be prepared that once you click submit, your control is gone.

Just like any digital medium. Email? Check.

They have not done anything yet, wait and see. But there are some interesting indicators.

Well...this is where it gets complicated. Sure, the US does have jurisdiction if there are crimes committed on the system that might pertain to US citizens. Also, of course, all the usual network surveillance applies post 9/11. But, the application of EU laws on the content thereof, doesn't depend on the location of the system involved for jurisdiction of the crime. The Local mentions Swedish/EU laws apply and then you get the Swiss involved and, well, hell...I once got out of a well deserved speeding ticket because the cop didn't want to deal with an out of state plate. Can you imagine just how bad it will need to be before anyone has their pant firmly and far enough up their buttcrack to pursue legal action? This is where I don't get the furor over a 1 page Terms of Use thingy because, worst case is that they'll just nuke your posts and close your accounts. Multi-national lawyers are expensive, particularly ones who specialize in internet law.

Why don't you be a big boy and come on here, eat some humble pie and apologise for the total lack of communication to us members? As was posted in the business forum recently, 50% of a successful business is happy customers. And the way I understand the direction of this forum, we the MEMBERS are in your eyes the customers.

So whilst I think the new T&C are somewhat bull, it is not something that gets me overly excited. But what annoys me is that we find out about things by accident, rather than having an up front communication about it.

That, in the internet age, is a very difficult question and in large part behind much of the difficulties in bringing movies and books to the online medium.

It's not a question that can be answered easily and, at best, one can say that, while you are the author, and you 'own' the words, you might not be able to direct how and when those words are used. Again, IANAL and this is some seriously deep and complicated sh1te when it gets down to the real deal. I don't know that this site is going to pioneer anything in the rights of forums users to get micro payments for readers so...it's likely not something to worry about.

Besides, the Swedes only pay in lutefisk and I can guarantee you that you probably don't want that.

Fair enough. But I think the difference is that if I don't like the changes to T&C from my bank I can move my money to another bank - or in the case of McD, I can go to Burger King instead. And when I take out my money of the bank, they are no longer there (I think). Whereas, here (if I understand it correctly) the Local reserves the right to use any copy they may have of anything I have posted, even after I have moved...

But hey ho, I guess no one is forcing us to be here and in reality I guess the impact will be minimal once things have cooled down a little.... Maybe we should all go out and get p1ssed on a Friday evening instead of posting on here....

Maybe they want to write a 230 page book about life in Switzerland gleaned from the information willingly provided by it's members (they wouldn't be the first) but I doubt there's a sex scene worth reading and anyway, by page 26 it'd just be pictures.

C'mon, 90% of us are frustrated IT geeks as what else are we doing here if we're not bankers? (and the bankers are mostly out doing what bankers do off line). We are notoriously terrible at communication and, to top it off, this community does have a penchant for hyperbole. Hell, the other day, someone from a film company, legit I might add, got his arse chewed off for asking folks to come be interviewed as part of a documentary. I'm not quite sure what drives this sort of sturm und drang here, but I do think its part of the cultural atmosphere.

Lighten up, the folks are paying the light bill and unless you've got a novel or expat guide that will surely sell to 10s of expats, relax and just see what goes.

I loved living in Sweden and enjoyed the Swedes immensely. They're less chatty than their southern european counterparts and I'm sure all this vitriol has them both puzzled and laughing and probably, at this hour, down at the local pub having a few drinks over it (and more laughing).

Alright Kemosabe, maybe think of it in terms of another kind. I've been on the 'net since 1983 when it was a nice, small academic community of folks. Later, in 1991 or thereabouts, on a BBS that I frequented, some guy started posting advertising on the board. I went ballistic. I don't understand why their need to pay the light bill through advertising suddenly transforms into, "They're going to sell all our collected wisdom" which is clearly not a rational statement as most of this stuff isn't printable and the stuff that is, probably needs a lot of rewriting.

Just relax. I've had a few glasses of wine and everything is always better when you're a bit relaxed.

True, but the MySQL server would need to be doing binary logs, and while that's the sane way to do things, folks rarely do it. ;-)
