Change of TaC: How to delete my posts?

I just got a mail with new Terms and Conditions.

"This site (www.englishforum.ch) is owned, managed and published by The Local Europe AB"

This is news to me. I joined when it was set up by Mark.

"By displaying or publishing any material or content such as texts, files, messages, photos, video, images, ... you grant to THE LOCAL a fully-paid, non-exclusive, and royalty-free), worldwide license to use, ... distribute such Contents on and through the Services or in media that are partners to THE LOCAL."

NO I DO NOT AGREE.

"This license will come to an end at the time you remove such Contents from the Services and upon your notification to THE LOCAL."

Good. How do I notify THE LOCAL?

"Regardless of this, a residual or back-up copy of the Contents posted may remain on the servers after you have removed the Contents from the Services, and THE LOCAL maintains the rights to those copies."

NO I DO NOT AGREE. I joined when Mark set it up. You cannot swipe someone else's intellectual property by changing the TaC retroactively!

The very reason I am on EF and not on Facebook is precisely to avoid such onerous TaC!!! If this is now in force, what is the point of the EF?

I want my posts removed and not backed up.

Can anyone help? How do I contact The Local?

And Mark's brother transferred ownership to The Local, announced here.

The only change Editor Bob said would happen is some commecial advertising.

Apart from that, Robert, Mark's brother, and Editor Bob from The Local, assured us nothing would change and...

Send 'The Local' an email stating that the reading of your message or the usage of any of your posts automatically cancels any previous agreements you have with the site, and that by reading or displaying your work affirms their agreement. Furthermore they agree not to enter into any more agreements with you and that any future changes to the T&C are automatically refused to be accepted by yourself. Furthermore, all efforts to obtain any consent from yourself render any assumed consent null and void.

Put them into a T&C catch 22...

They will drop out with time, and Wayback Machine has a deletion-on-request policy which I have used and they are prompt.

These TaC are a whole different kettle of fish.

I understand your concern Resident, but anything we post online is fair game to be borrowed and used by whoever wants to, even if you only post on your own website with heavy-duty boilerplate legal terms attached to the content. The reality is the Local is very very unlikely to benefit from

in any way. It's just extra blankets to cover their a$$. If someone wants to post photos that they don't want used for financial gain by others, put a killer watermark on it and link to your flickr account or something. Even in the old EF days anyone could save that image or link it to another forum or whatever.

I wouldn't flounce over the new terms and hope you decide to stick around.

It has been just a little more than a year now since my brother and founder of this fine forum left us all far too early in a tragic accident.

Since then, the forum has had uncertainties and ups and downs. I was closely involved with Mark in much of his forum development projects and I could not bear to get too close to the running of his forum for a long time.

While many people have worked very hard with little praise or appreciation to keep things running behind the scenes, no one has managed to keep things upgraded and feature rich as Mark always did.

The forum (as it stands) works, but as the net marches on, things break and need updating. It has pained me to see much of Marks work slowly break and not keep pace with changes. It has also pained me to see the disruptions and the downtime despite sterling efforts of some behind the scenes.

A little while ago, I intervened with some minor fixes following the last move and promised to sit behind the scenes and try to steer the forum in a better direction. I promised there would be some upgrades, fixes and changes on the way and today I can announce that this will begin in earnest.

I have decided to give the forum into the care of someone who is already quite capable of running a forum superbly. I have full confidence that he will be able to be a part of this community and give it the care, time and technical skills that are needed.

I have deliberated long over this decision and it has not been an easy one to make. I am quite sure however that this is almost exactly the same sort of decision that Mark would have made (though he may have done it a bit quicker).

I have decided that the future of this forum in order to be sustainable, (both technically and financially), will be in the hands of the right commercial model. This may initially upset some, but as you will see, there are many positives to this change and will enable the forum to reach the point that Mark had intended for it.

I have now handed over ownership to The Local, a small organisation who have a niche expat market and should be a nice fit for the community here. They do not intend to make any big changes in here and want to keep everything much the same as it is. You may notice a small logo in the corner, but I think that will be a small price to pay for having the forum kept as it should be. Ill let James explain that to you, but suffice to say that I would not have transferred the forum to them if I believed it would not be of benefit to the community and Marks legacy.

Some of you have also donated to keep this forum running over the last year and most of that has been used wisely on the hosting that is currently serving you. I will make it my task to properly investigate all donations and make sure that any left over funds will be offered to be returned. I want to make sure that everything is accounted for and nothing goes amiss. Please note: The new owner has nothing to do with past donations, nor will do. Please PM me if you have any concerns about this.

@Mud: That is not correct. There is a precedent case of a girl's photos of her friends being used by a t-shirt company.

Be that as it may, you cannot change a legal agreement retroactively.

I think that guy got banned because he had an IQ of 17 and a small todger but the EF couldn't admit to that reason in public.
