Unless the situation changes I will be deleting my account before 27th October.

I do not agree that everything I have written in the past, and which belongs to me
and is my intellectual property, should now belong to the Forum & The Local.

It may be drivel, but it's my drivel, and is not available to be taken away. If the
rules change, or the Mods delete all my old posts, I will stay.

Wow, how did I miss all of this today? And I was not even out enjoying the sunshine

I think we all need to take a chill pill (or maybe join the guy who wanted to help buying weed) and let the dust settle a little.

I don't per say agree with the everything in the T&C, but then again I don't disagree enough to not be part of this excellent forum - a place that has led me to meet some great people and form some great friendships.

As I mentioned on Friday, I think the main issue is the way that things are being implemented and "marketed" by the Local without communicating up front... And I guess some of us worry that the forum goes (more) commercial and we have to start worrying (more) about what we post and don't post.

But hey, let's stop hitting DELETE any more tonight, - go grab a drink and watch some telly instead... It will all be better tomorrow.

Oh, and can we pleeeaaaasssseeee have summerrain back? Pleeeaaaassseee

The change (not that I'm bothered) is that now, there's in fact nothing you can do about someone somewhere nicking your intellectual property (as it were), but that under the new T&Cs, you actually grant the owners of the site a legal right to use and sub-license your intellectual property.

Ok, but really.... Property of what? Tips on how to live in Switzerland? Bunch of informations mixed with lots of bla bla and jokes?

Maybe Ittigen can answer me, but what is on this forum that is so important to keep total ownership on?

Will it really make a difference? Will it really change something? Do you really thing they will take stuff you wrote to do..... what?

Presented the right way, the harshest of changes can be welcomed. Presented the wrong way, the most inoccuous of alterations can face opposition. One day people will learn that it's all in the delivery.

This isn't a reply specifically to Ittigen, alone, but to all those who object to The Local claiming copyright/ownership of their drivel posts.

Before reading further, be aware that I'm no lawyer, even less an expert on intellectual property law in Switzerland.

My understanding is that from EF's inception, when The Local in Switzerland was just a gleam in some avaricious Scandinavians' eyes, every post submitted to the Forum became the property of the Forum. EF held copyright over everything published on it. No member "owned" their own posts. What changed is that a for-profit company took over EF and ownership/copyright of the content of the Forum passed into the hands of said gleamy-eyed Swedes. But that was years ago, now. What's happened since is that The Local has formalised in writing the current situation and clarified it for the future. Really, nothing has changed. If you were happy to cede ownership and copyright of your "work" years ago when Mark owned EF, I don't really see why you'd feel very differently about it now.

As pointed out above, it's hardly likely that The Local is going to auction off the drunken scribblings or computer art of a bunch of English-speaking expats. What they may do is use clips or segments of posts to promote the site, to whip up their advertisers into a frenzy of excitement.

It's entirely possible that I've got this completely wrong. Please feel free to correct me if you're authoritative on the subject of IP law in Switzerland.

Well I have started deleting some of my old posts, and this has upset somebody.

I am now prevented from deleting my old posts as the "Edit" & "Delete" buttons have been removed.

Is anybody else receiving such treatment?

P.S. These buttons did not age and disappear, they disappeared during my deleting!

Yes, everybody. The "Edit" & "Delete" buttons disappear from posts after a certain period of time (I'm not sure how long).

Please don't delete posts. It disrupts the flow of threads and mods have banned members in the past for doing so. Not that that sanction carries much weight any more, now that one can ban oneself. (Is this a good time to mention MiniMia, too?)

Copyright usually lies with the creator ("author") of IP, unless the author allows somebody else to use whatever has been created. A photograph, for example. Or a cake frosting recipe. Or a description of how to import a car into Switzerland. Or a restaurant review. Not everything on EF is drivel.

Again, I'm not bothered. But I understand why folks might be.

Or unless that work is published. Also, I think there's implied permission to use one's work when one submits it to a public website. Again, this is my unvetted, unconfirmed understanding. I'm waiting for learned confirmation or otherwise.

For instance: I posted my photograph I took of my grandchildren dancing around a maypole. If some pervert alters that image, which is quite easy to do, then it is still my name on that photo, and I wish to have the right to delete it

Many of you work in and with IT and are much more savvy about t'internet. As an old biddie, I hadn't got a clue that writing on a Forum meant it was there for ever for all to see- and could be used by others to whatever ends. Naive? Stupid? Yes I know. Must say I am pleased I've not put my photo here- but much more importantly that of my children or grand-children. I can truly understand Ittigen's concern as he has put the location and date on the photo too.

Not worried though, as none of the drivel I've written here can come back to bite me (I think).

I did join another Forum once, and one of the Mods phoned people in my UK town from France to find out who I was! Friends asked why this guy was making enquiries about me, when we next visited. Incredible- but I can't see this happening here.

Premise: Copyright lies with the creator ("author") of IP, unless the author allows somebody else to use whatever has been created, or unless that work is published.
Premise: "Asterix in Switzerland" by R. Goscinny & A. Uderzo has been published.
Conclusion: Copyright no longer lies with R. Goscinny (well his estate - R.I.P.) and A. Uderzo. Hey! I'm free to reprint at will! Oh wait...

Conclusion^2: Whether a work has been published or not is immaterial in determining who owns the copyright.
