Help against somebody trying to screw me over

i hope someone can help. i made an agreement to buy a phone from someone for 50chfs and the seller agreed to this in writing. then later he went back on this and decided that he wanted 200chfs.

then, he tells me that the item is actually broken and is away for repair for 2 weeks. i agree to wait.


he then tells me that they might not be able to fix it, but instead might replace it with a refurbished/new item and in this case he will have to charge me more.

in an unrelated deal, he asked me to sell him a brand new item for less than half the retail cost. i asked him to pay before i commit to making an order for this custom item. he declined to pay instead wanted to offset this against the amount i pay him.

lastly, he encouraged me to make some bets on wednesday, which i lost and i suspect he actually won my money.

my question is: what legal rights do i have to get him to stick to the original deal and is there a way of making him suffer for messing me around (i.e. make him wear a sandwich board in paradeplatz saying "i'm an idiot").

Just cut the losses and avoid further contact.

A few years ago I learned a lesson: don't do deals with scumbags even if the deal looks very attractive. At the end it won't be.

well, the guy is a friend of mine, so i mainly want to see him wearing a sandwich board on paradeplatz. and preferably have people throw tomatoes at him

the 200chf deal was not in writing, but a verbal deal should be legal. also, he claims that if his phone is not repaired, then he can't sell me 'his old phone' as he wont have his old phone any more, but rather a new one and so is claiming 'force majeure' to void the deal.

To be honest Phil, some people have off-the-scale IQs and just shouldn't be dealt with as equals. Perhaps you need to come to terms with your station in life and not try and do business with those above/beyond you.

And how might one recognise one of these "scumbags", especially before the deal is entered into? I'm interested in this because I'd like to learn the same lesson as you learned and I'm just sitting here hoping I'm not responding to room temperature IQ fortune cookie wisdom.

I don't know the extent of / strength of your relationship with this guy but if any serious buddy of mine tried that with me, the friendship would be over. Period. Can't be doing with someone I consider a good buddy behaving like that to me. There are plenty out there who are not in that category who can hold that mantle.

He's a mate? ..... yet you want to know what your legal rights are re. written/verbal "contracts". If you've only lost out on a dodgy bet, (which supposedly you had some control over), I would seriously cut your losses, at this point, and keep your wallet hidden, whenever you see this "mate".

Alright folks..I think Phil got the message..why don't we ease up a little....not like he's the only one trusting somebody that they shouldn't have trusted. I'm sure every sinlge one of us has a similar story to tell. (Well, except maybe the betting part. )

LiB, I don't think he has gotten the message. He is hopelessly naive and even gets done over by his friends apparently. He needs to go buy a box of lego and sit alone and play with that. The world is obviously too much for him.

We do but as his friends the best advice we can give him is to lock himself away under the covers and not to engage in complex interactions. One day he can even be trusted with a key to his bedroom door in case he needs the loo at night, but not yet.
