Apple sues Samsung for...

Making a device that is rectangular with rounded corners and has rows of icons on the screen

Quote:
“Samsung’s Galaxy Tab computer tablet also slavishly copies a combination of several elements of the Apple Product Configuration Trade Dress,” Apple says in its suit, noting that Samsung’s tablet, like Apple’s, uses a similar rectangular design with rounded corners, similar black border and array of icons.

Apple has sued rival Samsung Electronics claiming that Samsung's Galaxy line of mobile phones and tablet "slavishly" copies the iPhone and iPad, according to court papers.

Galaxy products use Google's Android operating system, the lawsuit says, which directly competes with Apple's mobile software. However, Apple's claims against Samsung focus on Galaxy's design features, such as the look of its screen icons.

Quite right too...I posted previously about lack of innovation and iClones from Samsung. They are almost passing off iPhones in their design. I wish these inferior phones would stop popping up every week, wish that they would innovate without copying the design and the operation of the iPhone. We deserve competition not the 70's Made in Taiwan rubbish coming out of the iPhones competitors labs. Still, the Japs eventually got the lions share of the car Market, so I guess we must wait for the inevitable flooded Market of iPhone wannabes. The trouble is, these gimmicky clone phones price themselves up with Apple distorting the Market for quality and design.

They have nothing to loose doing that since they don't use the Samsung processor anymore.
It was definitely strategic for them to build their own embedded controller (A4, A5 etc...) to replace the Samsung device they were using previously.

The A4 and A5 may well be Apple's own design of an ARM chip, but it's still Samsung that manufactures them - at least for the time being. In fact Apple themselves don't actually manufacture anything at all. All of the production is contracted out to mostly chinese based manufacturing plants. Apple is purely software and product design company these days.

True. I should have said designed it, not build it. But they probably have another Asian fab ready to take over from Samsung. Before the A4 release they were tied to Samsung.
It is interesting that they restarted their in house design capability when they acquired PA Semi.

Re: Apple sues Samsung for...

To be honest this type of thing is always going on between the tech companies. Inevitably it will all be resolved by some kind of patent cross licensing deal. The only reason this is news is because it's Apple.

Samsung actually supplies Apple with a lot more than just the A4 and A5 chips. Take flash memory for instance. Samsung is one of the biggest players in this market, and Apple has a voracious appetite for flash memory, obviously as flash memory is the chosen storage medium for iPad, iPhone, all iPods with the exception of the classic, and the MacBook air products. Not to mention that Samsung also manufacture LCD displays, RAM, hard disks etc. All of which have appeared in Apple products at some time or another.

On the scale of things this is a very small squabble between the two companies, which IMO is unlikely to affect the relationship between them beyond that of the respective departments and legal teams responsible for the products in question.

Re: Apple sues Samsung for...

i think the components samsung provides for apple includes:

- the screen
- the processor
- the flash ram

they are also a heck of a lot cheaper than others, so apple aren't going to move without it costing them, even if they could find somebody with capacity.

Sure but that stuff can be second sourced. Prior to the A4/A5, Apple used a processor designed by Samsung and made by Samsung. Now that Apple owns the A4/A5 design, they can go shop it to different fabs.

Its more than just the look and the user experience, even the packaging is a rip off. Samsung can be an innovative company, so why not do things differently e.g. offer the Galaxy in a frisbee shaped box

Quite. If you are copying you are not "innovating" - I hate that word as much as the phrases "user experience", "quantum leap" and "paradigm shift".

If the below is true, it explains:

1. How Apple got away with it.
2. How it will become EU-wide automatically if Apple are successful.
3. Why Samsung cried about not being given a chance to make their case before the temporary injunction.

The Community Design: ...and you Thought the USPTO[1] Was Bad

[1] USPTO = United States Patent and Trademark Office I had to look it up.

If you're referring to Samsung, they're Korean, not Japs. But then again I guess they all look the same anyway, which may explain why their phones do too.

Some of you probably slept through "Marketing Strategy 201".
