Got cheated!: Ricardo first-time buyer did not pay!

Hello,

I have been using www.ricardo.ch for three years and so far had only good experiences. Last week a first-time buyer from 4923 Wynau bought my stuff and due to the urgency I sent him the item without waiting for his payment transfer to my account. The buyer had written me a mail after auction that he will send me the statement of bank transfer.

So as the story went, I did not hear anything from him since then... His name sounds foreign but I do not want to generalise anything as I am a foreigner myself. Just I felt sad to see someone resorts to just register a new account and cheat for 40 CHF. Maybe he will one day pay me but I am not optimistic as he could not be reached through telephone too. And as said he has not any user review at his account as he is new. This is probably my mistake for not thinking much about that before sending.

So a warning on other members here selling stuffs at Ricardo. Unless you send it via registered post, never send anything without getting payment first as ricardo can't help you if the buyer never pays and you don't have proof of delivery (although I find it bizarre that anyone can just register a new account and bid at your auctions without identification...)

I would amend this to...

So a warning on other members here selling stuff on any web site (ricardo.ch or even this one) get payment first and then send.

Even if it takes a couple of extra days, the buyer won't mind. If they wanted it immediately they would have come to your door or even just gone to the shop and bought it.

And put a very negative comment on that Ricardo user. Hopefully noone else will get done.

Yes, it was my stupidity. I admit that and want to share with you guys not to send anything without payment. I even thought to go to Betreibungsamt but I think the effort doesn't worth 40 Fr. Neither does the effort to go to Wynau personally....

I live in St. Gallen, he lives in Wynau (Canton Bern i think) The cost and time to go there will exceed 40 CHF, don't you think so? So does the cost to do a betreibung I believe...

And Ricardo said..."sorry there is nothing we can do as you have chosen option prepayment (Vorauszahlung) and there is no proof of delivery either"

Do you keep the bill with the tracking number from the post when you payed for the parcel? This number is unique, tracks the process and it will show if it was delivered and when it was sent. Confirmation Quittance is written in french, they give you with any A or B post pack you send. It's a long number that starts with 99.00.100900.XXXXXXXX

It was actually sent not in parcel form but letter. So no record whatever.

Anyway I tried to google his Asian name and it did not return many searchs. So either that guy has just reached CH that has no record whatever or just left CH again after cheating me...

You should definitively do this. Tell him that you are going to file a claim then give him a week and then go file a claim.

In my country it was easy. Prepaid number (so no traceability to owner) and a message saying: Hey man, some gipsys are going there over the weekend. see you soon in a near Hospital :d

Just threatening the Betribungsamt might work. You have his details, send a registered letter. Even without a signature a package can be traced. If you kept the receipt there is a tracking number. Parcels are insured with the post so you should also look into this.

Edit: I just read it was not a parcel. What is 40 chf that fits in a letter? Then for 5.00 you could have sent it registered mail.

Yes, I could have sent via registered post. As said, I could have, but I did not... . I wanted to trust the best of humanity and 40 CHF is just not the world right? Call me naive. But yet feeling cheated is not a good feeling. It is now more a matter of principle than the money (but of course the effort should be considerable, i.e. I am not going to Bern to ask for money personally). Has anyone actually used Betreibungsamt for a small amount like this?

I was thinking the same thing as he'll need to send a registered letter saying he wants payment before he sends it to debt collection. But it's too late for that now. Though it could hurt him in his claim. Let's hope the threat (of collections not bodily harm ) will bring him to his senses.

I believe the debt has to be at least Sfr 100 for a Betreibung.

Unlike Ebay.de, when I joined Ricardo, my password was sent by post, so I had confidence that the members' addresses are correct.

Does he speak English? Well he lives at 4923 Wynau, so we will all be very careful! (Wynau is in canton Bern, but nearer to Argau)
