Two villas for sale on Koh Samui, Thailand

Hi guys,

My friend is selling his own villas on magic paradise island - Koh Samui. The price is very attractive, much lower then market price. There are no third parties between seller and buyer.

Place is really wonderful.
Villas was build just couple years ago. It is not used most time so owner decided just to sell it. It will be very good choice for arranging holidays or other outdoor events for companies who want to have something unusual.
Two villas placed on one site with common swimming pool.

Each house has area 240 m2, place for both houses has area 800 m2.
Price for both houses with land - half million USD.

Can we have some details regarding titles please - are they on separate titles? Freehold? Leasehold? Tenancy in common with others on the site?

both houses at one place, ownership of both houses and the land is belong to seller.

It can be easily solved. First you register some fake business in Thai, then change the owner to yourself. After you can buy and own anything in Thai. It is a trick, but everybody know it and use it

Foreigners may not own majority stakes in a Thai business. Trading in land by foreigners is forbidden. The law is very clear.

Ownership of land by foreigners is forbidden by law, who on Earth would risk losing their house by breaking the law ?

You smashed two different points. Land and houses is owning by business, not to foreigner itself.
Foreigner own his business. This is forbidden to establish business in Thai without two Thai partners, but not forbidden after establishment a business take ownership to real owner and be only single person who own a business and make a deals from this business.
All things I'm writing are absolutely legal. Nobody going break a low and get unreasonable risks.
Do you realy think if all real esate owning would be not leagal Thai real estate makret show such growth as we've seen during last years?

As the owner of a house in Thailand I agree with you, however if doing this use a reputable company to set up the deal, there are a lot of sharks in the land of smiles

This does not sound totally legal, the fact you suggest that you set up a fake business to work around the legal position of ownership implies that should it be subsequently found out, then you risk prosecution and the loss of the property. If you were to have a genuine interest in a company which meets the legal criteria and as a bi product of this you became the sole owner and thus this then allowed you to purchase a property then fine.

Shell companies are a standard way of companies here in Europe doing business and are totally within the law, I am sure if you checked out your employer that if they have sufficient assets they will have shell companies too

To make you fake business not fake it is enough provide just one single payment through your account. For example you can buy something in the internet at you own web site. If you paypal or any other money gathering system physically is attached to your account in Thailand you will get absolutely legal income, pay taxes and will sleep calm. Nobody close your business.
It is very easy.

The main point - Thailand is very depended from foreigners. Government never come against people who make very good income for Thai economic. Be realistic!

Well, despite the twisting going on here, please make it clear that any potential buyer will never own the property outright and will have to use grey/back techniques to even get the purchase process started.

The link I provided has clear and certain points made about foreign owned businesses/houses and land.
