Work Permit/Passport for USA

I know someone, that is Swiss, and their girlfriend is Polish, both under 30, who are interested to work in the USA for 2 years for the experience.

Normally I don't see an issue, as he is educated in his profession and not too old yet. The problem is, is that he in the past 10 years recieved a ticket in Switzerland for posession of marijuana. Something that he did not to go to jail for. He admitted guilt, and got some sort of fine.

From my experience of knowing professionally a ton of DJ's, that traveling for work, possibly pleasure, with prior drug convictions will not gain you access to the USA. It's not a conviction like a judge and a jury, but it is an admittance of guilt. He also said if given the questionnare they give you where they ask a ton of questions, like links to terrorists, Nazi party involvement, etc, he would admit to the drug posession charge. Is it necessary for him to admit to this? And will it be held against him as per gaining acess to the US? I would think it would.

He has told me he will not lie, so therefore, what is the potential outcome of this...any idears?

Just like moving to CH a background check is done so assuming the same the other way around..if it's on a record somewhere it will be found, but don't think that would warrant not getting permit/passport for USA. But I am no expert just adding idears.

Not sure, and he'd probably want to contact a US immigration atty. I know that it's possible to get a visa, even a green card with a misdemeanor, such as a DUI. If the possession is similar to a misdemeanor, it's likely to be ok. But the possession has to be for a small amount. The number 30grams sticks in my head - is that like 2 oz or so? Anyway, he's right to report it. If it happened a while ago, that's better too. I'm no expert though, I just know people who've obtained visas etc with small things on their records.

from a friend's experience (honestly it is a friend and not me!!) - he had been tagged with marijuana almost 15 years before and driving down to the States from Canada the border guard decided to do a bit of an extra check on him and saw the record for drug possession and refused him entry and flagged his passport. And that was just to go to a concert. The US takes drug charges of any kind seriously, and there is so much going on in the last few years about the marijuana "industry" and keeping it on the illegal list vs legalizing it that it is a hot topic. BUT as it is not a formal charge, he may be ok. Definitely go talk to the consulate with some kind of documentation on what the offence is recorded as here. I don't think there is a country anywhere that looks into people's backgrounds as strictly as the US.

I have met an American who couldn't enter Canada because of a DUI charge. He wanted to cross the border on his bike and was forced to turn around.

True story.
