italian gay man in a relation with an american gay man

Hello!

I would like to know if someone may suggest a country in Europe where a gay couple may live and work.
We are an Italian man and an american one who would like to live together. Unfortunately, neither the States nor Italy allows us to be together.

I would appreciate any pieces of advice.

To be more clear, you're looking for a country that recognises same-sex partnership for the purposes of getting a spousal visa?

So you would first have to get married somewhere first as well. Or need a nation that recognises common-law partners as equivalent to married ones for giving visas and then one that also recognises this for same-sex partners.

Switzerland? Geneve more specifically?

I went to a gay marriage last summer. All held in Geneva and men exchanged vows, rings, etc... it was quite fun really

Yes. We are looking for a country where we could be in a partnership or marriage and that will allow us to work. In the States I can stay but I cannot work if I cannot find someone who is going to sponsor me. The same thing is for my country.

I saw that for instance, we could get married in Belgium but I do not know if my American partner would have the possibility to live there.

So basically you need any EU (+CH) country that recognises same-sex marriage. I am sure Google can help out.

We seem to have BE, CH so far.

Yes, if you have an officially recognized relationship (marriage or civil partnership) then you can live there. You've got a few choices, from the UK (which may be a good option as you both speak English) to scandinavian countries, the netherlands, etc. I"d suggest doing a search on the embassy websites for countries you're considering and finding out which ones might work for you, preferably with the least amount of paperwork

Good luck on finding the right place to make a new start together!

England recognizes same sex relationships so you could both settle and work there.

Re: italian gay man in a relation with an american gay man

It's more complex.
Countries with gay mariage do not necessarily allow to foreigners to come and marry there if none of the two already leaves there. It is at least the rule in Scandinavia and the Netherlands.
You would need to get to that country as a couple first, working both there. Then you both wait until you've been long enough there for marriage/partnership.

The one of you being american, he is the one to focus on: find a job in one of thoses countries. The italian one can follow as EU-citizen and stay six months anyway. In that time, you'd have to sort it out with the authorities as a couple having enough monay for two or find a job youself to get a permit of your own.

I am sure that Scandinavian countries, the Netherlands, Belgium and Spain give permits to partners of foreigners working legally in the country. For Germany, it's complex, as same law may be applied differently, but Hamburg and Berlin should be fine. Check with the ambassies.

As for Switzerland and England, I do not have current info and things can change very quickly.

Re: italian gay man in a relation with an american gay man

Thank you All!!!
:-)

I think that right now Belgium is the one that may give us more chances.
I saw that I can stay three months there and after that I can get married to my American fiance'. There is a law there that gives us the chance to get married if in your countries you are not allowed to. The doubt that I have is that since he is American I do not know if he can stay there just being my husband???

Re: italian gay man in a relation with an american gay man

Frankely, given some restrictions as gay in some countries, permits are mostly a question of money. If people can pay for themselves, authorities don't talk to you on the same tone. I've been foreigner as a student and now as working force, I feel the difference. Not only in Switzerland.

It sounds like you have to ring the belgian ambassy. Good luck.

As for the UK, there's a lot of useful info here, like notice requirements, immigration controls etc:

Hello sweetheart ! Actually, in the US you CAN legally marry in New Hampshire, Massachusetts, Connecticut, Iowa and Vermont. Just hope Obama will at least legalize civil unions for every State !

Too bad you can't do it in Spain, wouldn't that be romantic ? But just like with Spain, musn't you bee a citizen of Belgium/Sweden/Norway to marry a same-sex partner of a different nationality ? Need to do some more research on that...

Anyway, it's is a great pleasure for me to congratulate 2 happy people. I wish your life to be full of love and understanding, forever !

And nicest language ever (I love grammar, Icelandic just knocked me off in extasy) - I have to find time to learn it properly...

Excellent alternative. But the job question is unsolved yet.

Re: italian gay man in a relation with an american gay man

Caution with France. The partnership does only apply if one is French citizen and even then, it does not give the right to the partner to live in France. It is only an element of decision. Original text: un élément d'appréciation des attaches en France.
French parliament made sure the pacs has no relation what so ever to marriage or even slightly related to a human right.
It can still work in France if both partners have a job.

Re: italian gay man in a relation with an american gay man

I am very sad that you even have to ask the question.

You cannot just "live" without this rot.

My cousin has been with his partner for over 20 years (in the UK), they married straight after Elton John did.
How many other couples can say they have been together that long nowerdays?

It is amazing what so many of us just take for granted.

I think, if you are under 40 (it gets harder to immigrate then), you could also try New Zealand.
But I have been out of the country so long that I don't know what the marriage laws are. Certainly you would be allowed to live together.
