Housing Deposit: Getting it Back (what do when when landlord is cheap and dishonest)

I moved out my place, cleaned it for 20 hours, and the landlord said it was all ok except for a few keys I lost and a fridge drawer. He says they have to calculate nebenkosten, etc. and I would get the remainder mid November. I moved out end of September.

Now he says there is wood damage (over email) because he is a cheap bastard. There was wood damage there but it was there when I moved in.

Now, in the US and Canada, the landlord must give you an itemized list within 30 days or you get ALL your money back no matter what even if the place is trashed.

I want to know if there is something similar in Switzerland, because if there is, he has to give me ALL the money back no matter what.

Please advise if this exists or other things. Thanks. Not sure if I can find the papers when I left and what was on there or what was there when I moved in, but I would rather find out if an itemized list was required since I did not get one.

No, you'll almost certainly have to pay what he asks. Are you a member of the Mieterverband? If not, search for that on the forum and read further. They provide a type of arbitration.

Was the damage ticked on the list when you moved in? Our landlord provided a list, walked around with us and ticked all things " damages " or " worn out " , he left the list with us to be returned within 14 working days with any other remarks we might find.

Now, all things on the list are sorted and taken care off, and noted on an additional paper, signed by both.

In this way when we ever move out, we both have a list ( duplicate is with us) of what is done and how it looked, even took picture with datestamp for backup.

This list is really important - Aas far as I know, once you've been around the apartment with the owner and ticked this list when giving the keys back, any damage not identified at this time is not your responsibility. They have to identify the damage at the time. Joining the Mieterverband might be a good move - they will be able to advise you about your rights, but you have to be a member with them for 3 months before you come under their legal cover (rechtsschutz).

First thing, this 30 day US/Canada thing does'nt exist here and this is I really miss. I get the feeling you did not have the itemized list when you left, as he would not have come up with this later on. The rest you will have to stop by (and fast) with your local MV office.

The owner has to prove that the wood damage was done by you. Tell him that it was there before. You do not have to pay anything if you do not agree with it.

Read your housing deposit agreement with the bank. Normally you can get you money back after one year if no legal action is going.
