my flatmate left what should I do?

hey every one
my flatmate just left switzerland without notification.
or both name is in contract.
what will be happened next?
do i have to pay the whole rent? or just my part.
can i complain ?

Have fun haggling with the landlord on that basis ;-)
You have to pay the whole rent.
Go and find a new flatmate or a new flat.

You are both jointly liable for the rent. If he isn't paying his share, you are still accountable for the full amount.

so, in that case what about responcibility?
what will be happen to deposite?
we rent the flat for 1200 and we each were payed 600 and each paied 1200 for deposit.(two month deposit)
as u said right now I have to pay the whole rent!! what will be happen to deposit?
as I already mention it we both are in contract
is there anyway to cancel the contract and get back my deposit?

The landlord doesn't care which one of you may or may have not left, simple fact is, he will only be happy as long as he gets his rent money and anything else is your responsibilty!

As rainer_d said, go find a new flat mate.

600 is not that much in Basel and you will get someone very quickly no doubt.

Someone may correct me here but you wont be able to 'get out' of that contract just because. You will have to give your proper term of notice and after the apartment has been cleaned and checked you then get the depo back after 1 or 2 months.

The deposit is held to cover damages, not replace unpaid rent. If you terminate the contract early you are still liable for all rents due. Try and find a sub letter and move out, else get a room mate. you will not get your deposit back until the contract ends or you have given/served the correct notice period. If you want all of your deposit back, stick to the contract.

I think it might be a bit difficult to go after the flatmate and claim money if he is out of the country. I lent money to a chap who "disappeared", only to "resurface" in London. I tried to claim through a debt collection agency - no chance, there are too many laws protecting debtors. Never lend money again, that's what banks are for. If they won't give you the dough, then there must be a reason....

Back on topic, you have to pay the whole rent. No way out.

Whats to go after - he left his deposit behind didnt he? if the rent is 1200 and they gave 2400 deposit i assume the contract is with 60 days notice, so give notice, make sure the flat is straight and recover the money through the deposit repayment

Sorry, I take it back. I didn't read far enough down the thread to see the clarification.

I'm not a lawyer, nor do I have a solid understanding of Swiss contract law. But I guess the answer here depends on whether two people signing a contract here are "jointly and severally" liable for the rent.

I'll defer to someone who actually knows what they're talking about.

At least you can get back his part of the deposit if you leave the appartment in perfect condition.

Are you a shareholder of the "mieterverband"?
This is the most used answer on any topic in connection with flats and so on.

Contacting "Mieterverband" would be the last step for me only when I get nowwhere an appropriate answer.

"Mieterverband" is not to mistake for "the helping hand" or Caritas.

If both names are on the rent contract, normally you could only terminate the rent contract together.

Of course you can complain, and your flatmate would be liable to you for his half of rent until the apartment can be validly terminated. But the crux is in collecting any money from you flatmate.

To be on the safe side try writing him an e-mail (registered letter is better) saying that you need his signature on a letter authorizing you to terminate the rent contract and/or finding a new flat mate to replace him and/or finding a Nachmieter. Explaining that you will hold him liable for his part of the rent until such time that you can terminate the rent contract or replace him.

BTW: you co-signed a rent agreement who just goes ahead and skips the country.... I assume you knew the person slightly before assuming such a responsibility...

Use the website below to advertise and look for another flatmate, and at the same time talk with your landlord, it also depends how ur contract is signed.
