Legal advice needed/landlord changed number of rooms

Hi guys,

I'm in a bit of a pickle. I never thought that something like that is possible but apparently these things happen. The situation is as follows:

I came to Zurich in October, 2010. Before coming here I found a place via internet. This was a 2 bedroom + living room, I agreed to share the apartment with whoever the landlord will find with clear idea that it's gonna be one more person.

A couple of days after I moved in I found out that the landlord found a couple to live in another bedroom. I wanted to raise the question of our agreement but decided not to escalate the situation and since the couple gave me enough space in the living room and the kitchen it was alright. Unfortunately, they had to move out and that's when the problems started.

5 days ago I left Zurich for a couple of days and when I came back I saw a bed in our living room. Apparently, the landlord decided that he can make a third room out of the living room and let one more person live in the apartment. They didn't discuss these terms with me and when I asked what was going on, they offered me a discount of 50 francs when my current rent is 1300 chf. Since a guy moved into the living room not only do I have zero access to the living room space but also to the TV and the balcony.

Obviously, I'm going to move out and started to look for another place right away. I've asked to reduce my rent to 1000 chf and cut the notification period to 2 weeks because of the new circumstances but apparently my landlord doesn't think it's reasonable. I don't plan on staying here for more than 1 month (my contract expires in March), so it's not a very big deal money wise. I'm just super pissed with the fact that people try to make money at my expense and put me into this situation post fact without prior discussion.

My question to you EF'ers is:
1) Is it legal for landlord to do that?
2) What can I do to receive the compensation that I think is reasonable.
3) What would be my costs if I decided to take this case further to a legal mediator?

I'm gonna go and see if I can get legal consultation on that issue and also consult with Zurich tenants' union but maybe you guys have other ideas on how to tackle this issue.

Again, 200-300 francs and an extra guy living in the apartment that I'm gonna move out from soon is not the worst problem in the world but I'm still very stressed out by the fact that I am being treated in that way.

2) What can I do to receive the compensation that I think is reasonable.

Go to your Gemeinde and explain the situation, join a Mieterverband. You won't easily get any compensation.
3) What would be my costs if I decided to take this case further to a legal mediator?
Very large

There is a saying here: being in the right and claiming your rights are two different things, often widely apart.

It depends a bit where the 'clear idea' came from. What exactly does your contract say?
