Long wait for Deposit repayment - Possible Discrimination

Hi guys,

just wanted to know your opinion on this and maybe some good advise.

I´ve been living for the last 3 1/2 years in a flat that is run by BGM Better Living.

All fine, never a problem and/or a complaint until last November when I left the flat.

They came for the inspection and actually could not find any single thing to charge me for, flat was absolutely spotless.

I contacted the man in charge of the agency and he said that I would have received the Deposit back in 2 or 3 months.

When I saw no money coming in, I called them and asked where my money was, another lady said ohh yes we´ve had some delays but by the end of Jan 2011 you will get it, as you can imagine no money came in by end of Jan so I called and sent emails and they´re basically ignoring me.

Actually a friend of mine (german speaking friend) called them since they could not express in none of the languages I speak and provide me with some kind of good explanation for the delay, and a guy said to this friend of mine, please tell Mr .. that either he stops bugging us or we´re making him wait the full year !

I called the mieterverband and apparently they can keep the deposit up until a year, which is fine, if this is what the law says, I would have just expected this people to be sort of decent and civil and at least reply saying something.

Anyway I think they should sort of explain why I am waiting and I do suspect that they´re abusing of a law just because they got fed-up of me chasing, which would have not happened if they would have kept their promise on the first place .. swiss precision .. yeah right I can only laugh!!!

My German is not good enough to tell them to f**off and gave me my money back or at least reply to my emails, and I do suspect I might not see that money back ever again.

Does anyone have an idea ?

It looks like you are going to be patient or wait until November 2011 doesn't it?

Not much you can do now, so relax and enjoy yourself. Call them on 1st December 2011 and tell them you are issuing a Betreibung.

There has been no discrminination as such. Not on colour/creed/religion/sex etc...

They are acting within the law. It is the law that is wrong/unfair.

It's tough. It feels like you are being screwed over. Sorry.

You can get back at them a little bit. Any interest your security deposit has accrued is yours. That means that right this minute you can go to the bank where your security deposit is held, show your documentation and take out the interest. Depending on how much your deposit is,the interest can adds up to a nice sum. I did it once and my interest was around 350chf. They have to give the information where your security deposit is located-by law. Its fun because they don't expect a tenant to do this plus they don't think they know about it. Good luck...
