Swisscaution and my agency

Hey,

So in June 2010 I moved out of my apartment, had the hand over, agreed what work needed to be done and what we would pay for, signed the form and left. A month later received no bill from the housing agency so I rang them asking about it and they said they would send it. Oct still no bill again I rang and got the same thing. Eventually in end January I received our "Abschlussrechnung" final bill, 7 MONTHS after moving out!! They then decide they want paying within 14 days. Which I don't do as I don't have all the money so we agree a payment plan to pay over 2 months. All ok.

Now for the Swisscaution part, our swisscaution premium renews in November of the year. Now we moved out in June 2010 so was paid up to November 2010 with swisscaution. When we moved out our agency said that they will cancel the Swisscaution. in November I received a renewal for swisscaution which i thought was strange so i rang them to be told that the agency hasn't cancelled the contract. Well I rang the agency and they said they would do it when the final bill was paid, which of course they hadn't sent to me and they didn't know when it would be sent. So I didn't pay Swisscaution, then today I get a Mahnung requesting paying I rang them again and told them that I paid the final bill from the agency yesterday (which i did) and that they should be canceling the contract this week. Swisscaution told me that I would still have to pay for November-March because they had to keep my old apartment Insured against me in case I didn't pay the bill.

Now do you think I can do anything about having to pay swisscaution for 4 months? I cannot see a reason for the delay in the agency issuing the final bill because when I did receive it in January it included invoices for the repair work done which was dated in July, so basically everything was done they knew the final amount we owed but didn't bother to issue us the bill until 6 months later?????

And the delay has nothing to do with the heating cost and housing maintenance bill as this was issued to us separately in January which was paid.

Hope my post and question is clear. Thanks as always for the advice.
