shared rental agreement rules?

Hello,

Does anyone know the "rules" that govern a shared rental agreement?

I have a friend who rents a shared apartment. Person A is "owner" of the deposit (put down the full amount of the deposit). Both person A and B are listed on the rental agreement, with their respective signatures.

Person A demands person B to leave the apartment in under 2 weeks. Is this legal? Can person A demand person B to leave in under 2 weeks?

What is the normal legal timeframe to leave an apartment?

Because 'person B' is named on the rental contract he has a right to live there. He can ask the Mietverein for advice.

If 'person A' changes the locks etc 'B' can call the police. Obviously 'B' should start looking for somewhere else very soon.

He should write to the owner explaining the situation, the owner will probably demand the full notice period and in writing from 'B'. If 'A' leaves now, then owner will be left with 'B' whom is also leaving.

Don't forget, even though 'B' has no deposit he is also legally responsible for breakages, damages, no rental paid etc.

Messy situation indeed!

That's what I thought, thanks! There's a moral implication too. My friend, person B, has fractures in her spine (from a non related accident) and totally lost in what to do, now I know how I can help her (getting her a lawyer! some people are just ...)
