No, the works will not start until I leave (then a couple of weeks for next tenant).

The issue is that chances of finding a tenant in the current state are less than if they would let me go and then show the appartment.

More than 7 weeks adverstised, more than 15 visits and appart from refused family no other applicants even if appartment is 600 CHF below market price according to comparis...

So.. many parties interested, for price, location and dimensions ... but disappointed and not applying. If works are not done, I do not see how I will get new tenant!!

Huh? That doesn't seem right. If no one can move while you are paying the rent they can't hold you responsible. Did you go to the tenants' association. If not you need to do that today.

I have just seen that la gerance has updated the homegate advert ... and they announce that floors and painting will be done new... AND THEY HAVE INCREASED THE CHARGES BY 20 CHF / MONTH!!

I am at Asloca tomorrow morning to try to get them involved and send them a letter requesting l'etat de lieu pour June 1st.

Conditions are changed but only increased charges. Asloca tells me that they are allowed to do so even if those are not the conditions in my contract.

There are other arguments to consider but quite weak.

They suggest I try writing a letter to Commision de Conciliation to put on hold contract until conciliation is done.

But ... they think I am still responsible to look for another tenant even if la gerance is advertising different conditions.

I do not understand Suisse laws... even the secretary at la gerance had told me that if works were meant to be done, I would be liberated!

Sorry for my long story by chapter, quite a relief though to share it!

So... after going to Prefecture for opening "conciliation" on June 1st (of course paying June rent as well), I found another tenant which was accepted and I had my etat de lieu today ... with 0 CHF penalties!! (I paid 980CHF for nettoyage profesional).

However, on the letter they sent me to communicate I was free, they backdated to May 31st even if it was posted on June 8th (same day that la Prefecture contacted them about my claim).

"Dirty people" in this gerance... they did it so in conciliation they might try to play that they had released me even before I took them to la Prefecture.

Well, as long as I get my 1/2 rent back and my Swiss Caution garantie... I will desist on my demand.

Final chapter!! (I hope...)

Any way you slice it, you are supposed to present several possible future tenants; they check for solvency, for debt, and also want to rent an apartment for "good" population, so a 3 bedrooms doesn't go to a single person, and vice-versa, a study doesn't go to a family of 4.
You are on the hook up to the end of your legal binding contract otherwise.

I am not sure offering to pay the costs was a good idea, but too late for that. You may end up paying a part of it anyway!

Normal wear and tear come into play if you have been in the place for a long time: paint jobs and wall-papering are supposed to be lasting 10 years; so after that long, they are redone to no cost. Before, you'll pay a % of the refurbishing anyway, usually covered by your deposit money.

Last but not least, look for a cleaning company or plan 2 days for the last cleaning before the état des lieux... it includes washing the ceilings, the heating elements, rubbing down the walls, filling any holes done with nails...

Sounds like they will give you all of June back if they letter was back dated to 31st May. Good news anyway. They were shady and I'm glad you took action!
