Is it legal to sublet a sublet ?

Hi there,
Just wondering what are our rights in terms of sub-letting our sublet.

Our sublet is 100% legal (ie: registered with the regie, we have a deposit at the bank, a signed contract etc...). We are leaving he Geneva for 3 months and we would like to know if we would have the right to rent our apartment while we're away.


What do you think?

Hi, before I approach them, I want to know what my rights are. so far the regies we've dealt with have been far from easy to work with...

Surely this is mentioned in your current sublet contract (just like any contract), or am I missing something?

nope, it's not.

So far the best answer I have is from this webesitr, but it only applies if you are the main renter and not a sub-renter.

This article talks about seb-letting, not sub-letting a sub-let - which I really don't think can be done legally, re Insurance, etc.

I agree with Odile in that you probably can't sublet as you are not the tenant. My guess would be you'd have to ask the tenant (the person you sublet from) to sublet it for you during the time you are gone.

It's really up to the management company. If they are ok with it, they can draw up a contract and all is fine. This is the correct (and legal) way to do it.

I certainly would NOT do it without their approval- as you would find yourself liable possibly for any damage, or if they default on payments, etc, etc.
