Neighbor's cigarette smoke in my house

Not sure where to put this.

I want to be a complaining neighbor, but not sure how to go about it.

I could smell the cigarette smoke wafting in through my windows earlier today. I just left to take the dogs for a long walk, and when I came back home, the apartment smells like a friggin' ashtray.

I looked out over my balcony and down on the ground floor there's a gathering of about 10 people, and they're all smoking. No doubt it comes up and in through my windows.

Is this something that I could legitimately complain about?

I've read threads on this topic before and the conclusion seems to be "no"; people are allowed to smoke on their balconies. You can ask them not to do it, but I guess they'd keep doing it anyway.

If I smoked, I'd also expect to be allowed to smoke on my own balcony.

I would tend to agree. But there is quite a difference to one person having an hourly cigarette and ten people chain smoking.

I was also thinking that since there are rules about charcoal grills for similar reasons, why not for cigarettes?

I figure in the end I'll get over it.

Tom, closing windows? In the summer? Hahahaha!

It depends on "hausordnung" (house rules). We aren't allowed to use a barbecue on our balcony but other buildings in our area are.

I thought that even if the house rules say you can't use a BBQ on your balcony, you still can. You just need to co-ordinate it with your neighbours.

Did you complain (a couple times) about people complaining about you? IIRC, you didn't like it very much.

Technically, no.

But it doesnt hurt to tell the neighbour nicely that 10 people chainsmoking outside your apartment really is a bit OTT for you as a non-smoker, and if they would please find a new place for their habit.
