Landlord trying to force me out

Hello

A brief synopsis. I moved to Switzerland recently and had arranged to sublet a room in an apartment. We exchanged emails and skype calls in the run up, during which I said I smoked and enjoyed an occasional drink. He wasn't happy with the smoking but we proceeded.

I moved in and signed a contract with a 3 month notice period. After three days he handed me my notice as he will shortly be moving to London to start work. He also claims the smoking and is a major concern.

The atmosphere is quite poisonous and I am trying to find an apartment of my own but my landlord is applying pressue to move out by the 10th of Oct. As you and I know, finding accommodation is not that easy.

I am therefore wondering what my rights are. I will try and move out early as that would be great for both of us but I don't want to move from shared flat to shared flat. Am I within my rights to stay for my 3 months and would the Swiss system back me up? Even if it turns out that he wasn't allowed to sublet.

Hey there,

I am not an expert on law but if you have a written contract, you should have no issue with getting backed up by Swiss law.
The problem is that he is not allowed to sublet (as far as I understood you) He would get in trouble for subletting but you might have to vacate the apartment latest with him. I would suggest you talk to

They no all about tenants' rights in Switzerland and will support you if you need help. The issue is that you seem to have an "illegal" contract. Talk to them, they wont turn you in but advise.
He himself can only get out of his (I assume) 3 months notice period with the owner of the apartment if he finds a new tenant to take over his lease and release him of his liability.
Worst case, ask the landlord if the sublet was legal.

Thanks Kat. I do not know if he is allowed to subet or not. He has in the past and I saw the advert on WGzimmer. but that means nothing under law (i guess). Thanks for the link, that sounds very useful. I'll give them a call/ email.
