Notice Period Question ( Kündigung )

I have two notice periods in my contract, 3 months before the end of March and 3 months before the end of September. If we give 3 months notice on Nov 1, we are are 2 months shy of the end of March. Does anyone have any experiences where the management company was cool with a 3 month notice period regardless of finding a tenant? Or are we going to have to give up the dream apartment we just found? There is no way we can pay 2 sets of rent for 2 months and I am not convinced we can find a tenant to sign and take over our existing apartment in 3 months.

Hi

depends where you live e.g. demand in the area, and also on person who is dealing with you from agency.

Though generally speaking, most of the agencies avoid doing that since it means more work for them. We are in similar situation as you, and might end up paying 2 months extra rent on one of our apartments (though in our letter we have mentioned that we are flexible to vacate the apartment earlier; next step is to call up person dealing with account and see if they could adjust, but not pinning any hope for that to happen)

Most agencies do not allow a Kündigung between September and March because, in their words, it is very difficult to find a tenant during winter.

Your solution is usually finding someone who will take over your apartment before March. Otherwise you will be stuck paying 2 apartment rents for a couple of months - your old one till March, your new one as soon as you take over it now.

If you found your dream apartment, paying 2/3 months extra rent on the old one might be worth it.

Thanks everyone. As feared, they will not just accept a 3 month notice without finding a tenant. They were pretty nice though and said they would be looking for a new tenant in addition to our efforts. I think we will go for it if we are approved for the other place!
