Dishwasher problem / contract

Ok, rant time. Ready? Good.

So we moved into an apartment with a new dishwasher start of September. In fact everything was new according to my landlady. Joy of joys.

However, the dishwasher pushed water up the pipe and into the sink. That caused the dishwasher to have a cardiac arrest. Emailed the landlady and was advised by her that her husband thought this was straightforward & that I should get under the sink and disconnect the pipes and empty them and this should sort it out (and here I thought I was paid to do non-manual stuff...!). Anyhows, I did that (rather than whatever it was I was going to do) and that DIDN'T do the trick and in fact resulted in some water leaking from the pipes... ugh. Not cool X. They then sent round the hauswart who also looked at it to no avail. Then the dishwasher engineer came and got the machine working but the water was still coming through. He advised that we get a plumber in. Mentioned all this to the landlord and he said that swiss pipes are narrow and this is our problem. Funny that in all the other places I lived, the landlord normally sorted these sorts of things out. In fact, the last landlord came round himself. What a guy...

So, looking at the HEV contract, my current landlord / lady is indeed right. Under Tenants Duty it states 'Tenant shall be responsible for repairing minor defects necessary for the normal use of the property.'

Part of such minor repair work, regardless of its costs are -

- maintaining the devices in the kitchen (dishwasher installations)
- blah blah blah
- And all minor repair and maintenance work which does not, in a single case, exceed 1% of the annual net rent

If I am to read this correctly, if the dodgy dishwasher goes kaput, then I have to fork out the full cost for replacement. Or have I misread this? I am mystified why I didn't receive a bill for the engineer that already came. And I am further mystified by the last bullet point. Is the last bullet point talking about all OTHER minor repairs or does it include the dishwasher? If for arguments sake, my 1% = CHF200 and the dishwasher bill is CHF300, would I would have to fork out only CHF200?

I can't work out why I have to shell out for something that hasn't really worked in the first place and clearly would like some damage limitation here. I don't seem to have the same provisions in my UK apartments - I just buy the tenant a new dishwasher once in a while...

Summary: I need to buy my own place here

Dishwasher does not function.

Apartment requires NEW dishwasher, or immediate repairs.

Owner pays for dishwasher replacement, or repairs.

Unless, of course, you have used the dishwasher for a period extended over its guarantee period?
