Minimum rental term before contract can be terminated?

Dear All,

Apologies if similar question has been asked before. I’ve search forums but to no avail.

In terms of renting an apartment, is there a minimum term a tenant has to live in the property before the contract can be terminated? What if I find an apartment, sing the contract move in just to find out I have neighbours from hell or I simply find better apartment. Can I give an agreed notice say after 3 or 6 months?

Any help much appreciated.

What does your contract say?

In general terms, if your contract says something like "first date of cancelation possible Dez. 2012" you would only be able to cancel it in 1 year. You should be able to cancel it, though, if you find someone else to take the apartment for you.

What is important is: what does your specific contract say?

it doesn't matter what your contract says... you can leave when you want - as long as you line up a suitable replacement tenant.

a friend of mine signed for an apartment, and realized within a few days that she had made a mistake.. this wasn't what she wanted. she found another place, advertised the old one and found a replacement tenant, and was out of there in 3 weeks!

I haven't got a contract yet. I'm coming to Zug 1st of January 2012 and I find it almost impossible to find a temp apartment (at reasonable price at least - I was quoted 4000 CHF per month for temp room this morning). As I would need a permanent place anyway, I may just try to find it now without looking for a temp. However, as you can appreciate, it's much more difficult to make a judgement on the right place and apartment from the UK.

Yes, as somebody already suggested you should first read your contract and see what it says. It is so different between the contracts and landlords. But if you accept appartment and then you say no before signing the contract, sometime they charge you 100-200 CHF.

If you are not coming before January but think it´s something interesting for you, ask them to mail the contract to you.
And for your question: what if I find better appartment? Well, it is a decision as every other we have to make.

But if you do that and turn down the apartment, be aware that there's often an application fee of 100-200 CHF that you'll get hit with.
