Getting married - can my fiance move in?

Hi all,

I'm pretty sure this must have been answered somewhere on the forum, but I couldn't find a thread that answered my question... If I missed it please just point me to it!

I'm currently living alone in Switzerland, and the lease is only in my name. I will be getting married late next month, and shortly thereafter my fiance (then wife) will join me in Switzerland. She's not currently living here.

I will tell this to my landlord in the next few days, but my question is - what can he do? Can he refuse? Can he raise the rent? The nebenkosten? Something else?

He's a pretty easy going guy, and I don't expect any problems. But since it's better to be safe than sorry, I thought it best to ask what my rights and obligations are in this case.

I tried Google Translate, and even though the translation to English isn't very good it seems he has to accept it? If it matters, my apartment has 1.5 rooms... Would that be (legally) enough for 2 people?

The same thing happened to me- my husband was already living in Switzerland when we got married. It shouldn't be a problem, and in my case (granted this was seven years ago) the gemeinde announced it to the landlord, because they had to call the landlord and ask if the property is big enough for two people to live there. In other words, your apartment has to be big enough under swiss law to accommodate a second person.

I don't think telling your landlord first would hurt, but unless you are in a 7m2 studio, it is the gemeinde who decides if she can live there, not really the landlord.

You could eventually add her to the lease with an amendment, but we didn't do that and it isn't mandatory.
