Help: impossible to end a fixed rent contract?

Hey everyone! I have a question about endinga fixed rent contract and hope that you can answer it...

Well, my husband and I have been renting an apartment on a fixed and non-renewable contract which ends in March. (We moved in Switzerland from abroad and the current apartment was the only one we were able to rent one year ago, when we needed to move...) We had been looking for a new one for a long long time and finally got accepted for one apartment which starts on February. We called the agency and asked if we could hand back the current apartment at the end of February so that we don´t have to pay double for March. The lady on the phone said it was possible, but we needed to inform them writing a letter. But after we wrote them a letter telling them about our situation, they informed us that we still need to pay for march.
Is this normal? Paying for two apartments for two months is too much for us... But it was impossible to find an apartment which exactly starts from April... We are really helpless... Does anyone know what we should do? Thanks!

It might not be that easy as the contract was fixed and non-renewable. Is there a reason why the contract was fixed i.e. will the owner move in himself after your moving out? If so, it would be extremely difficult to find someone to rent the place for just a few weeks.

I don't know if you could sub-let it someone who is also house-hunting and would otherwise have to live in a hotel or similar?

Ah yes, that might have even been my apartment in Lausanne.

It sucks, that's why I tried to caution people who were looking at my apartment that it was a fixed contract and that creates a lot of problems (which I had no idea about when I first moved to Switzerland).

If you try and find tenant they will have to fulfill the exact end term of your contract and then have to move out. At least with my previous Regi they needed people to be continuously moving out of the apartment to fulfil legal requirements so they could always empty it if a company wanted the space.

Best of luck, Switzerland leases suck and especially that one.

Thank you Cereus! The régie says that we can find someone who wants to rent our apartment for one month. But we still need to be responsible for the apartment when we hand it back to the régie at the end of March. I hope I can find a careful tenant in March and there´s no problem when handing back over... sigh and pray...

You signed a contract which was quite clear, you now want to get out of the contract 1 month early meaning you expect the landlord to have 1 month less rent that what was agreed.

How would you feel if the landlord had come to you on 31 December and said i want you out by 31 January, thus depriving you of one month that you had envisaged.

You signed, now respect what you signed instead of complaining it's unfair; it's very fair for both you and the landlord.

I hope that's not the case with my current apartment I have a one year fixed term but thought it then moved to a "normal" contract. I thought it was because I have moved nearly 9 times since living here

Yeah Mimi, I thought that with my contract - one year and then changes to a normal one. However, that was not the case and I almost ended up unemployed and homeless! Better check it out!

I think "normal" contracts roll over with the same conditions at the end of the term where as a fixed contract ends on the date specified (ie, no rollover).

We've been offered a fixed one year, thereafter "rolling over" to a standard periodic tenancy (ie one that continues until terminated by either party in accordance with the terms of the lease). I haven't yet seen the lease but suspect that both landlord and tenant have the right to walk away at the end of the year so have so far interpreted it as there being no tenant right to roll over to a periodic tenancy, merely the ability if both parties wish it.

It´s an apartment as a temporary lodgement, so it can only be rent on a fixed period of time... And that´s what makes it so difficult, because if we don´t find a new apartment, we´ll have no place to live; but if we do find one but it starts earlier, we´ll have to break the contract. In Switzerland, when finding an apartment is already difficult, finding one that exactly fits the time of the contract is next to impossible. What´s more I really can´t agree when the régie said on the phone "you have one whole year to find an apartment that starts on April"... God knows how difficult it already was for us to find this one that starts on February...
